MBZ, Waskita And Acaset Toll Corruption Trials Prioritized To Winning Projects

JAKARTA - PT Waskita Karya (Persero) Tbk and PT Acset Indonusa Tbk (Acset) are said to have been conditioned to win the Sheikh Mohammed bin Zayed (MBZ) or Jakarta-Cikampek or Japek II Elevated Toll Road construction project for the Cikunir-West Karawang section.

The inauguration was revealed when the Public Prosecutor (JPU) confirmed the investigation report (BAP) of the Head of the Auction Committee of PT JJC Yudhi Mahyudin when he was examined as a defendant in the alleged corruption case of the MBZ Toll Road construction, Tuesday, July 2.

Initially, the prosecutor questioned the auction document provided by the former President Director (Managing Director) of PT Jasamarga Jalan Layang Cikampek (JJC) Djoko Dwijono.

"In your BAP number 9, you said that when Mr. Djoko gave the auction document to you, there was a conveyation that later the winner of this auction was Waskita-Acset? Have there been any submissions, sir?" asked the prosecutor in court.

Then, Yudhi said that Djoko did give special directions during JJC's inaugural meeting with the auction committee.

The special directive in question is the construction of the MBZ Toll Road is a national strategic project (PSN). Then, the winner of the auction must have been known before February 2016.

Djoko's last directive was to ask Wasita-Acset to be prioritized as the winner of the Jakarta-Cikampek toll road construction project.

"Indeed, there are directions that as far as I remember there were three. The first is PSN, the second is that early February the candidate for the winner must have been caught, the third is that Waskita is right to match sir," said Yudhi.

"Is there an emphasis there?" asked the prosecutor.

"Yes, right to match, indeed in the document there is a right to match, sir," said Yudhi.

"What does that mean?" asked the prosecutor to investigate.

"So the right to match if the definition is I don't know what it means, so he (Waskita-Acset) is prioritized around that," said Yudhi.

The prosecutor then questioned the reasons behind Waskita and Acset being prioritized for the project to win.

"Yes, so for example, if Waskita's offer is number 3, bid number 1, for example there is a (company) Karya. Later (the offer) will be offered to Waskita, not with a value as big as the value of the appeal (Karya)," said Yudhi.

"It's not uncommon in such an auction process?" asked the prosecutor to investigate.

"To my knowledge, I have directions like that," he continued.

Former President Director (Managing Director) of PT Jasamarga Jalanlayang Cikampek (JJC) for the 2016-2020 period, Djoko Dwijono, was charged with causing state financial losses of Rp510 billion in the corruption case, with details enriching KSO Waskita-Acset of Rp367 billion and KSO of Bukaka Krakatau Steel worth Rp142 billion.

Corruption was carried out together with Sofiah Balfas, Djoko Djijono, Tony Budianto Sihite, and Yudhi Mahyudin.

The four defendants were charged with violating Article 2 paragraph (1) or Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.
