Application For Electronic Cassation And PK In Supreme Court Applies May 1

The submission of Cassation and Review (PK) at the Supreme Court (MA) can be carried out entirely electronically, starting from the deed of application for cassation and review dated May 1, 2024.

Delivery of the application file for cassation and review as intended is carried out through the 5.5.0 version of the Court Case Information System (SIPP) application, which has been officially launched by the Chairman of the Supreme Court M. Syarifuddin in Jakarta, Friday, April 26.

"We are all grateful that finally thanks to God's pleasure and maximum efforts from all of us, the request for cassation and review of the Supreme Court can be carried out fully electronic, starting from the deed of application for cassation/reconsideration dated May 1, 2024," said Syarifuddin as quoted from the official website of the Supreme Court of Justice in Jakarta, Sunday.

Syarifuddin believes that the application for cassation and electronic review legal remedies will bring significant changes to the case examination system in the Supreme Court. With the enactment of this policy, no more printed document files have been sent to the Supreme Court.

"The examination of cassation and review cases fully uses case files (Bundel A and Bundel B, ed.) in the form of electronic documents," he explained.

According to him, this electronic system makes it easier for the case examination process because access to files can be done without being hindered by time and place. However, the Chief Justice of the Supreme Court reminded that electronic documents are vulnerable to be changed or modified.

I remind you of the importance of the role of quality control clerks in the first instance. The QC (quality control) process becomes very necessary in the implementation of cassation submissions and electronic reviews," he messaged.

Meanwhile, the Supreme Court Registrar Heru Pramono said the system of filing cassation and electronic review legal remedies was the priority program of the Supreme Court. To implement the electronic judiciary, the Supreme Court has issued three policies.

The three policies, among others, are Supreme Court Regulation (Perma) Number 6 of 2022; Supreme Court Chief Justice Decree (SK KMA) Number 207/KMA/SK.HK2/X/2023; and Supreme Court Registrar Letter Number 712/PAN/HK1.2.3/4/2024 dated April 23, 2024.

"Electronically, the submission of cassation and PK is part of the online court implementation sub-system which is one of the priority programs for the modernization of case management mandated by the 2010 '2035 Judicial Update Blue Prints," said Heru.

He explained that the Supreme Court Registrar was preparing implementation instructions (juklak) to implement the application for electronic cassation and review legal remedies.

"Currently we are also preparing for a demonstration or instructions for the implementation of electronic cassation/PK legal remedies. If we have compiled the guidelines, we will immediately publish them," he said.
