Bawaslu Kaltim Prepares Written Information On Election Disputes For The Constitutional Court

The Election Supervisory Agency (Bawaslu) of East Kalimantan Province (Kaltim) prepared a written statement on the Dispute of Election Results (PHPU) to be submitted to the Constitutional Court (MK). "We acted as the party providing information, based on the results of the supervision and the Bawaslu decision related to the PHPU involving the Democratic Party and the United Development Party (PPP)," said a member of the Law Division of the East Kalimantan Bawaslu Dispute, Danny Bunga in Samarinda, Monday, April 23, which was confiscated by Antara. In preparation for the trial at the Constitutional Court, the East Kalimantan Bawaslu had collected the results of supervision during the vote recapitulation process at all levels of the province. Danny explained, in the Democratic Party case, there were reports of violations submitted by citizens, which were then responded by Bawaslu with a decision related to administrative violations. "We will submit these results to the Constitutional Court, but Bawaslu is not involved in dispute over election results, only in terms of administrative violations," he said. For the PPP case, there are no reports of violations from the public or other political parties, however they have filed a lawsuit related to the alleged lack of votes to the Constitutional Court.

"Today the Constitutional Court announced a presidential election dispute and is currently waiting for a preliminary hearing schedule for the Legislative Election, although no schedule has yet been set," said Danny. The East Kalimantan Bawaslu emphasized that they certainly provide accurate information and are in accordance with the results of the supervision that has been carried out. Currently, the East Kalimantan Bawaslu only handles disputes for the election of the DPR RI, and no lawsuits have been filed for the provincial and city-level legislative elections. "Meanwhile, we are continuing to prepare while waiting for the trial schedule by the Constitutional Court," said Danny.

The East Kalimantan Bawaslu has held a coordination meeting to prepare for the preparation of written information in the PHPU in 2024. The meeting was held for Bawaslu districts/cities throughout East Kalimantan in Samarinda on Friday 19 April. A coordination meeting was also attended by the Regional Bawaslu level II which prepared the PHPU. Previously, the Democrat Party's lawsuit began with a difference for the last seat in the House of Representatives of the Republic of Indonesia (DPR) with PAN. A total of 398 votes became the determinant, raising reports of administrative violation disputes to Bawaslu. Samarinda Tri Sukma Putra residents became the initiator of the report. In his complaint, Tri Sukma suspected that there was an administrative violation in the process of recapitulating vote calculations at the sub-district level in the East Kalimantan region. According to them, there were at least 49 District Election Committees (PPK) spread across nine districts/cities in East Kalimantan, except Mahakam Ulu, who were involved in the violation.
