The Wife Of A TNI Doctor Suspected Of Violating The ITE Law Proposes Pretrial
JAKARTA - Anandira Puspita (34), wife of a member of the TNI Kesdam IX/Udayana unit Lettu CKM drg. Malik Hanro Agam filed a pretrial against the Denpasar City Police (Polresta) for his determination as a suspect on suspicion of violating the Electronic Information and Transaction Law.
The pretrial submission was submitted on Thursday at the Denpasar District Court, Bali by AP's attorney, Agustinus Nahak and his friends as petitioners to the Denpasar Police Chief.
"We see that this case is very tendentious in cases of arrest and detention. The second is very forced, so it is worth canceling it by pretrial," Agustinus said as quoted by ANTARA, Thursday, April 18.
According to Agustinus, AP's client was named a suspect and was forced and inappropriate because AP's actions regarding upload or post material were not found regarding his household problems with Lettu Agam and dragged AB's name into the case.
In addition, there is no strong evidence regarding AP's role in uploading the destruction of his household on an Instagram account @yohajarlaporkan6 because the account belongs to Hari Soeslistya Adi (38).
Therefore, legal action taken by the Denpasar Police does not have to rush and prioritize the humanism side considering Anandira Puspita still has to pay attention to her child who is still a toddler.
"In our opinion, the arrest is very tendentious because this case is not an extraordinary crime, so the police should always prioritize the humanist system," said Agustinus.
Agustinus saw many irregularities in the process of determining the suspect until the detention process even though some time later his client was released due to pressure from the public.
So, said Agustinus, it is natural to use a mechanism based on the space provided by the Law to take legal action related to the determination of suspects that must be canceled by the court.
Then, another basic thing that needs to be done for Anandira Puspita at the beginning of this case is to provide mediation space.
"I say there is no hoax here, the evidence is complete, a case like this should be given a mediation room, because this is an ITE case, not a robbery, terrorist or corruption case, he said there had been a letter for mediation, it was a hoax, nothing at all until now," he said.
Previously, the Denpasar City Police named Lettu Agam's wife as a suspect in the alleged violation of the Electronic Information and Transaction Law (UU ITE). By investigators, Anandira Puspita was charged with Article 48 paragraph (1) Juncto Article 32 paragraph (1) of the Law of the Republic of Indonesia Number 11 of 2008 concerning Electronic Information and Transactions in conjunction with Article 55 paragraph (1) of the Criminal Code (KUHP).

Currently, Anandira Puspita's detention status has been suspended. The police said that the process of determining the suspect and his detention was in accordance with standard operating procedures based on the police report LP/B/25/I/2024/SPKT/POLRESTA DENPASAR/POLDA BALI dated January 21, 2024, with the reporter on behalf of Ahmad Ramzy Ba'abud.
Denpasar Police Chief Kombes Wisnu Prabowo said that the suspension of detention of Anandira Puspita was based on humanitarian principles.
