Komnas Perempuan: The Delay Of Ratification Of Implementing Regulations On The TPKS Law Can Have The Effect Of Domino
JAKARTA - The National Commission on Violence Against Women (Komnas Perempuan) views the issuance of the implementing regulation of Law Number 12 of 2022 concerning the Crime of Sexual Violence which has a domino effect on the handling of cases of sexual violence.
"The efforts to strengthen government-based and community-based service institutions are not optimal. Monitoring is also not working, strengthening the capacity of the apparatus is still lacking," said Komnas Perempuan member Rainy Hutabarat in a webinar entitled "Discussion of World Women's Day 2024" in Jakarta, quoted from Antara, Saturday 16 March.
He said discussing the implementing regulations of the TPKS Law requires cross-sectoral coordination, including human rights institutions, such as the Witness and Victim Protection Agency (LPSK).
"It was promised last year that it was ratified, but so far it hasn't," he said.
In 2024, which is a political year, it is also suspected that it has a role in making the issuance of the implementing regulations for the TPKS Law more distributed.
Komnas Perempuan is currently preparing a draft monitoring of the implementation of the TPKS Law, which involves service institutions.
This step is as mandated by Article 83 Paragraphs 1 and 4 of the TPKS Law.
"Komnas Perempuan mobilizes three institutions, Komnas HAM, the National Commission for Disabilities (KND), and the Indonesian Child Protection Commission (KPAI)," he said.
The government has agreed to establish three government regulations and four presidential regulations as implementing regulations for Law Number 12/2022 concerning the Crime of Sexual Violence, namely the Draft Presidential Decree on the Technical Implementation Unit for the Protection of Women and Children; Draft Presidential Decree on the Implementation of Integrated Services in Handling, Protection, and Recovery at the Center; and RPP on Coordination and Monitoring of the Implementation of Prevention and Handling of TPKS Victims, currently still waiting for initial approval.

The draft Presidential Decree on the National Policy for the Eradication of TPKS will still be reunited.
In addition, Presidential Regulation (Perpres) Number 9 of 2024 concerning the Implementation of the TPKS Prevention and Handling Training Center has been promulgated in the 2024 State Gazette of the Republic of Indonesia Number 14.
