Former Head Of NTB Energy And Mineral Resources Sentenced To 5 Years In Prison In The Corruption Case Of East Lombok AMG Iron Sand Mining

NTB - Former Head of the Department of Energy and Mineral Resources (ESDM) of West Nusa Tenggara (NTB) Muhammad Husni was sentenced to 5 years in prison. Husni was found guilty in the corruption case of PT Anugrah Mitra Graha's iron sand mining (AMG) in the Dedalpak Block, East Lombok.

The verdict was read out by the Chief Justice of the Mukhlassuddin at the Corruption Court at the Mataram District Court (PN), NTB, Tuesday, February 13.

"To try by imposing a sentence on the defendant Muhammad Husni with a prison sentence of 5 years," he said Tuesday, February 13.

In addition to criminal penalties, the judge also stipulated a fine of Rp. 200 million, subsidiary to 2 months in prison.

The judge sentenced Muhammad Husni to be proven to have participated in a criminal act of corruption jointly related to PT AMG's activities mining of iron sand in the Dedalpak Block for the period 2021 to 2022 without obtaining an approval letter for the planned budget activity (RKAB) from the Ministry of Energy and Mineral Resources of the Republic of Indonesia.

Dengan menyatakan demikian, jaksa meminta agar majelis hakim menetapkan perbuatan terdakwa yang menjabat sebagai Kepala Dinas ESDM NTB periode 2013 hingga Agustus 2021 itu melanggar Pasal 2 ayat (1) juncto Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dengan UU no. 20 Tahun 2001 jo. Pasal 55 ayat (1) ke-1 KUHP sesuai dakwaan perdana pdana umum.

"Turut menetapkan agar terdakwa tetap berada dalam penjabatan," ujar hakim.

The judge determined that Muhammad Husni's actions were proven to have violated the first primary indictment in accordance with the prosecutor's demands. The difference in the material of the verdict is found in the main sentence imposed.

The prosecutor previously requested that the panel of judges impose a sentence on the defendant for 9 years in prison with a fine of Rp. 500 million, subsidiary to 6 months in prison.
