The Defendant Of Extortion At The Gilimanuk Cekik Balance Office Was Charged With 5 Years In Prison Plus Replacement Money Of IDR 2.5 Billion

DENPASAR - The Public Prosecutor (JPU) has demanded that the defendant in the corruption case of illegal levies (extortion) at the Gilimanuk Cekik Motor Vehicle Weighing II Made Dwi Jati Arya Negara be sentenced to five years in prison.

The charges against the defendant Arya Negara, who served as the Coordinator of the Service Unit (Korsatpel) at the unit office, were read out by the Public Prosecutor of the Bali High Prosecutor's Office, Anak Agung Gede Lee Wisnu Diputera, during a trial at the Denpasar Corruption Court (Tipikor), Bali, Monday, February 5.

The prosecutor stated that the defendant was legally and convincingly proven to have committed a criminal act of corruption as stipulated in Article 12 letter e in conjunction with Article 18 of Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law No. 20 of 2001 concerning amendments to Law no. 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1 jo. Article 64 paragraph (1) of the Criminal Code.

"Demanding, imposing a sentence on the defendant for his guilt with a prison sentence of 5 years reduced while in temporary detention with an order that the defendant remains detained. Sentencing a fine of Rp. 300 million, subsidiary to 6 months in prison," said Public Prosecutor Agung Lee as quoted by ANTARA.

In addition to demanding a prison body, the prosecutor also charged an additional penalty of Rp2,521,484,999.

In front of judges led by Heryanti, Nelson and Soebekti, the prosecutor asked that if the defendant was unable to pay the replacement money within one month after the court's decision obtained permanent legal force, then the defendant's property could be confiscated by the prosecutor and auctioned off to restore state finances.

If the defendant does not have sufficient property, then he will be replaced with imprisonment for 2 years and 6 months.

Based on these demands, the defendant Arya Negara will file a memorandum of defense with his legal advisor at the trial which will be held on Thursday, February 15, 2024.

Previously, the defendant Arya Negara together with I Putu Nurbawa and Ida Bagus Ratu Saputra (separate prosecution files) were jointly charged with illegal levies against the driver who crossed the Gilimanuk Motive Weighing Bridge, Jembrana, Bali.

The defendant Arya Negara and two other defendants were caught in a hand arrest operation (OTT) from the Bali Police Extortion Saber Task Force on Tuesday (11/4/2023).

They were arrested for committing extortion, namely asking for money from truck drivers who passed the Cekik weight bridge at a rate of Rp. 20,000 to Rp. 200,000 each time they crossed depending on the violation they got. However, the money was used for their personal needs.

In this case, the defendant Arya Negara as the UPPKB Cekik Korsatpel abused his authority by ordering the squad commander (danru), members of his squad and staff to collect money from passing goods transport drivers.

Two defendants, Gusti Putu Nurbawa who is a civil servant (PNS) at the Ministry of Transportation as a guard officer, and Ida Bagus Ratu Suputra as a contract employee who served as a traffic staff has received a verdict for Denpasar Corruption Court judge with a one-year prison and a fine of Rp. 10 million.
