KPK Will Issue New Sprindik In The Wamenkumham Case
The Corruption Eradication Commission (KPK) has confirmed that it will issue a new investigation warrant (sprindik) to ensnare former Deputy Minister of Law and Human Rights (Wamenkumham) Edward Omar Sharif Hiariej or Eddy Hiariej.
Head of the KPK News Section Ali Fikri said the issuance of this new sprindik was intended so that the investigation into the alleged bribery and gratification that ensnared Eddy could continue. This kind of step has also been taken to ensnare the Director of PT Loco Montrado, Siman Bahar, whose suspect status has been canceled by the South Jakarta District Court (PN).
"Yes, technically it is the same. Then a new investigation warrant was issued to continue the process of resolving the case," Ali told reporters, Thursday, February 1.
Ali ensured that the investigation into the alleged bribery and gratification that ensnared Eddy would not stop even though the suspect's status was canceled. This is because the pretrial decision only examines the formal aspect.
Meanwhile, the material aspect of Eddy's alleged actions has not been tested at the Corruption Court (Tipikor). "KPK conducted an in-depth analysis and discussed in a forum with all leaders, structural prosecutions and the KPK Legal Bureau team," he said.
"It has been decided that the KPK will continue to handle the case," continued the spokesman with the prosecutor's background.
Even so, the anti-corruption commission will first improve the administrative process of Eddy Hiariej's case. Ali promised that every development would be delivered.

As previously reported, the KPK lost the pretrial lawsuit against Eddy Hiariej. This is because the sole judge decided to determine the suspect in the alleged bribery and gratification case was invalid.
"The judge reached the conclusion of the defendant's actions which determined the applicant as an invalid suspect and had legal force," said Judge Estiono, Tuesday, January 30.
In considering the decision, it is considered that the KPK does not have enough evidence in determining the suspect as regulated in Article 184 paragraph 1 of the Criminal Procedure Code (KUHAP). The judge also assessed that the article used to determine Eddy Hiariej as a suspect did not have binding legal force.
The articles used by the KPK are Article 12 letter a or Article 12 letter b or Article 11 of Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Corruption in conjunction with Article 65 of the Criminal Code.
"The trial, in the exception, stated that the defendant's exception could not be fully accepted," said Judge Estiono.
