Proven Corruption, Former Director Of Arun Aceh Hospital Sentenced To 6 Years In Prison
The panel of judges at the Corruption Court at the Banda Aceh District Court sentenced former Director of Arun Hospital, Lhokseumawe City, Hariadi, to six years in prison.
The verdict was read out by the panel of judges chaired by R Hendral and accompanied by Ani Hartati and R Deddy respectively as member judges at the trial at the Corruption Court at the Banda Aceh District Court in Banda Aceh, Monday, January 29.
The defendant Hariadi was present at the trial accompanied by his legal adviser. The trial was also attended by Public Prosecutor (JPU) Zilzaliana.
In its decision, the panel of judges stated that the defendant Hariadi was legally and convincingly proven guilty of committing a criminal act of corruption in the management of Arun Hospital. In addition to imprisonment, the panel of judges sentenced the defendant Hariadi to pay a fine of Rp. 300 million, subsidiary to six months in prison.
"Declaring that the defendant Hariadi was found guilty of violating Article 3 of Law Number 31 of 1999 which was changed to Law Number 20 of 2001 concerning the eradication of corruption in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code such as the indictment of the subsidiary of the public prosecutor," said the panel of judges.
Regarding the state loss of Rp44.9 billion, the panel of judges disagreed with the public prosecutor. The state loss is the responsibility of former Lhokseumawe Mayor Suaidi Yahya who became a defendant in the same case, but with a separate file.
"The money to compensate for state losses has been charged to the defendant Suaidi Yahya, so the defendant Hariadi is not charged with paying him," said the panel of judges.
Based on the facts at the trial, said the panel of judges, it was revealed that the defendant and the Mayor of Lhokseumawe Suaidi Yahya transferred the management of Arun Hospital to the private sector. In fact, the hospital is an asset of the Lhokseumawe City Government
"The management of regional government asset hospitals should have been carried out by forming a regional technical implementation unit or UPTD. However, the defendant and the mayor formed other companies. The hospital is a grant from PT Arun, an oil and gas company," said the panel of judges.

The verdict of the panel of judges was lighter than the demands of the public prosecutor. At the previous trial, the public prosecutor charged the defendant Hariadi with 15 years in prison and a fine of Rp. 800 million, subsidiary to eight months in prison.
In addition to imprisonment and fines, the public prosecutor also demanded that the defendant Hariadi pay compensation for state losses of Rp44.9 billion. If he does not pay, the defendant will be sentenced to five years in prison.
Based on the judge's decision, the defendant Hariadi and his legal advisers and the public prosecutor expressed their thoughts. The panel of judges gave the parties time to think about whether to accept the verdict or file an appeal for seven days.
