International Court Orders Israel To Stop Genocide In Gaza

JAKARTA - The International Court of Justice (ICJ) ordered Israel to stop genocide in Gaza, on the basis of the rights of Palestinians not to become victims of genocide to be protected, in the trial of the alleged genocide case filed by South Africa.

The trial was chaired by the President of the International Court, Judge Joan E. Donoghue, with a composition of judges consisting of 15 permanent judges, as well as two ad-hoc judges, namely Dikgang Moseneke who represented South Africa, and Aharon Barak from the Israeli side.

"In court view, at least some of the actions and negligence committed by Israel in Gaza appear to be included in the provisions of the genocide convention. Taking into account the following matters, the court concluded it had a prime fatie jurisdiction to handle the case under Article 9 of the Genocide Convention," Donohugue said. January 26.

"The court cannot approve Israel's request not to examine the request," he added.

On that occasion, the President of the ICJ cited several inciting comments made by Defense Minister Yoav Gallant, then Minister of Energy, Israel Katz and President Isaac Herzog, which could be interpreted as an attempt to kill civilians in Gaza.

"The facts and circumstances mentioned above are sufficient to conclude that there are at least some Palestinian rights that must be protected from acts of genocide and acts prohibited in Article 3 of the Genocide Convention, and South African rights to seek protection for these rights," said Donoghue.

The President of the ICJ said the terms for issuing a temporary action decision against Israel had been fulfilled.

"Israel must take action to stop and punish any public incitement to commit genocide," Donoghue said in his ruling, quoted by The National News.

He added that Israel must ensure its troops do not commit genocide and must also ensure evidence of alleged genocide remains.

The court ruled that Israel must take all measures to stop all acts of killing or injuring Gazans.

"Israel must ensure the military does not commit acts of genocide." said the judge.

In addition, Israel must also "provide urgent assistance to address the bad conditions facing Palestinians in the Gaza Strip."
