TPN Ganjar-Mahfud's Arrest Of Palty Leads To Criminalization

JAKARTA - Director of Gakkum & Advocacy TPN Ganjar-Mahfud, Ifdhal Kasim expressed suspicions about the report process until the arrests made by the police were made as submitted, namely reports given to the police on January 16, 2024, and on the 19th, Palty had been arrested.

"From the reporting period to the arrest, it raises a question mark. The report should have been processed from the reporter's examination first. But this is a very short time, from January 16 to 19, there have been arrests of those suspected, so there is a clear sign that this is leading to criminalization," said Ifdal.

He also said that the arrest and examination of Palty according to the ITE Law could only be processed based on the complaint offense. Thus, he continued, those who have to report related to the video of raising support for candidate pair number 2 which was redistributed by Palty should have been carried out by the Dandim, Kapolres, Kajari and Pjs. Regent of Batubara.

"The complainant must be the person or party who is harmed by the video circulating. But until now we have not known who reported it, and the police have not explained that," Ifdal said as quoted by Antara, Saturday, January 20.

A similar statement was made by Firman Jaya Daeli, Deputy Deputy for Law of TPN. According to him, if there are no complaints from officials and officials in Batubara Regency, the alleged intervention of other parties in the Palty arrest case is very strong.

For this reason, in addition to assistance to Palty, the TPN legal team Ganjar-Mahfud will also return to the main issue of this case that there are elements of the state from the point of view of this video that must determine whether they report, and whether they have been questioned for the complaint that ensnared Palty.

"If no one reports, then Palty's arrest is to cause public fear to be critical or voice out of suspicion of fraud in holding the 2024 General Election," said Firman.

He also stated that TPN encourages digital forensic testing of videos circulating and this must be done by an independent team, not from the police.

"So this must be dismantled, not only by arresting Palty, but the source or truth of this video is not disclosed," said Firman.

He regretted that the police were involved and intervened in this case, especially since Bawaslu as the electoral supervisory agency had stated that there was no problem.

"So with this problem we are in a position to take legal steps but we want to be opened by the police who reported it, or complain because if there is none, the police have gone far and this is a waste of time too," said Firman.
