DKPP Session, UIN Legal Expert Considers KPU To Violate Code Of Ethics To Set Gibran As A Vice Presidential Candidate

JAKARTA - Expert from the Professor of Law at the State Islamic University (UIN), Ratno Lukito, said that the KPU committed 6 violations of the code of ethics in establishing Gibran Rakabuming as a vice presidential candidate.

Ratno in the meeting room of the Election Organizers Honorary Council (DKPP) said the Constitutional Court's Decision Number 90 was a decision that had non-executive nature.

"Because according to Law No. 12 of 2011, Article 10 paragraph 1 letter D and paragraph 2 and their decision on the formation of legislation must be followed up by the President or the DPR to change the legal norm of the article or paragraph in the law," said Ratno, Monday, January 15.

Law Number 12 of 2011 concerning the Establishment of Legislations, Ratno said, regulates the mechanism for amendments to the law.

"The KPU violated its oath and promise to implement and enforce the 1945 Constitution and the laws and regulations, this is a very serious violation of ethics committed by the KPU," explained Ratno.

There were 6 violations of the KPU commissioner's code of ethics according to Ratno. First. Counter-laws by accepting registration and establishing Gibran as Bacawapres because the age requirement does not meet 40 years according to DKPU number 19 of 2023.

Second, cheating by giving Gibran special treatment by stating that he met the age requirements when registering and establishing it as a vice president's reading.

Third, abuse of power with arbitrary acts without legal basis receiving Gibran's list and establishing it as a vice presidential reading.

Fourth, carry out legal smuggling to accept registration and accept legal status as a vice president to Gibran

Fifth, commit evil conspiracy to fight the law and promote Gibran to accept his registration and get status as a vice president.

Sixth, providing false information in the minutes document receiving Gibran's registration.

Today's DKPP examined experts in the examination trial of four cases of alleged violation of the Election Organizer Code of Ethics (KEPP) involving the chairman and members of the KPU.

"The main agenda for the third trial is to hear the Expert Witness presented by DKPP at the request of the Complaints," said DKPP Secretary David Yama.

The four defendants complained against the Chairman and six KPU members, namely Hasyim Asy'ari, Betty Epsilon Idroos, Mochammad Affifudin, Persadaan Harahap, Yulianto Sudrajat, Idham Holik, and August Mellaz.

The chairman and members of the KPU were complained about having accepted the registration of Gibran Rakabuming Raka as a candidate for vice president on October 25, 2023.

According to the complainants, this is not in accordance with KPU Regulation Number 19 of 2023 concerning Candidates for the Presidential and Vice Presidential Elections because the Defendants have not revised or changed the regulations related to the Constitutional Court Decision Number 90/PUU-XXI/2023.
