Kominfo Officially Issues Ministerial Circular On Artificial Intelligence Ethics

JAKARTA - The Ministry of Communication and Information Budi Arie Setiadi officially issued a Circular Letter from the Minister of Communication and Information on Artificial Intelligence (AI) on Friday, December 22 at the Office of the Ministry of Communication and Information.

"On December 19, 2023, I have signed SE Menkominfo No.9 of 2023 concerning Artificial Intelligence Ethics. This Circular is a form of response to the rapid use of artificial intelligence or more popular artificial intelligence or AI in daily life," said Minister of Communication and Information Budi Arie Setiadi in Jakarta.

Budi said that this SE is in effect today, to be fulfilled by business actors and electronic system operators in organizing artificial intelligence-based programming businesses.

Furthermore, the Minister of Communication and Information also emphasized that the SE Kemenkominfo RI will apply in the territory of the Republic of Indonesia, including platforms from abroad operating in Indonesia, such as Meta and Google.

"There is a platform two (platform) from outside, right, but while operating in Indonesia, they should pay attention to ethics or ethical guidelines through the Circular of the Minister of Communication and Information Technology," said Budi further.

On the other hand, Deputy Minister of Communication and Information Nezar Patria also conveyed, with this SE, Kominfo hopes that business actors in the private and public sectors can refer to the rules or ethical guidelines made.

"For example, there is an accountability principle, so this ai product is at least accountable and transparent. It fulfills that principle, the principle of transparency, at least he declares that the product is a generative product of AI," added Nezar.

Although this SE is not legally binding and ethical, Kominfo emphasized that, if there is a violation that occurs, it can be prosecuted through applicable laws such as the ITE Law and the PDP Law.

"If you ask how the legal problem is, it refers to the two laws, if if they violate or can be subject to sanctions or articles from the ITE Law and PDP, they can legally be processed," he said.

Finally, Budi hopes that the organizers can make this circular letter of Artificial Intelligence as a guideline for the development and utilization of AI in their activities specifically in making and formulating internal policies regarding internal data and ethics of artificial intelligence.
