JAKARTA - The requirements for the age of the presidential and vice presidential candidates are again tested at the Constitutional Court (MK).
This application was submitted by four Surakarta residents named Fatikhatus Sakinah, Gunadi Rachmad Widodo, Hery Dwi Utomo, Ratno Agustio Hoetomo, and a resident of Sukoharjo Regency named Zaenal Mustofa.
The petition, which works as an advocate and legal consultant, is testing the constitutionality of Article 169 letter q of the Election Law.
As for Article 169 letter q of the Election Law, it reads that the requirement to become a presidential and vice presidential candidate is: q. The lowest age is 40 (fourty) years or has been / is currently in the position elected through general elections including regional head elections.
Deputy Chief Justice of the Constitutional Court, Saldi Isra, in the trial asked the petitioners about the application submitted. Saldi firmly said that the petition submitted by the applicant was already in the previous Constitutional Court decision.
"Have you heard the 141 decision in 2023 (Decision Number 141/PUU-XXI/2023), have the verdict been read?," said Saldi in a hearing held Monday, December 4.
"Because we see that the application is already in the previous decision. But we cannot prohibit it because of your right (to apply)," he continued.

The Constitutional Court (MK) previously rejected the presidential and vice-presidential age lawsuit of at least 40 years or had served as a governor proposed by the Faculty of Law at the University of Nahdlatul Ulama Indonesia, Brahma Aryana.
Chief Justice of the Constitutional Court Suhartoyo rejected the application for case Number 141/PUU-XXI/2023 related to the judicial review of the age limit for presidential and presidential candidates or having served as governor.
"Rejected the applicant's application in its entirety," said Chief Justice of the Constitutional Court Suhartoyo in the Court Building I 2nd Floor Session Room, Jakarta, last Wednesday, November 29, in his official statement.
