Anwar Usman Did Not Participate In UNUSI Student Lawsuit Regarding The Age Of Presidential And Vice Presidential Candidates

JAKARTA - Former Chief Justice of the Constitutional Court (MK) Anwar Usman did not participate in deciding Case Number 141/PUU-XXI/2023 submitted by the students of the Faculty of Law, Nahdlatul Ulama University Indonesia (UNUSIA) Brahma Aryana, regarding the minimum age requirements for presidential candidates (candidates) and vice presidential candidates (cawapres).

Chief Justice of the Constitutional Court Suhartoyo said the case that sued Article 169 letter q of Law Number 7 of 2017 concerning Elections as interpreted by the Constitutional Court Decision Number 90/PUU-XXI/2023 was decided in a panel of judges (RPH) by eight constitutional judges, except Anwar Usman.

"Similarly decided in the RPH by eight constitutional judges, namely Suhartoyo, as chairman of concurrent members, Saldi Isra, Daniel Yusmic P. Foekh, M. Guntur Hamzah, Arief Hidayat, Wahiduddin Adams, Manahan MP Sitompul, and Enny Nurbaningsih, respectively as members, on Thursday (23/11)," Suhartoyo said in a hearing reading the verdict in the Courtroom. 2nd Floor, Building I MK, Jakarta, Wednesday 29 November, confiscated by Antara.

Pantauan di lokasi sidang, Anwar Usman juga tidak terlihat hadir di ruang sidang. Hanya ada delapan hakim konstitusi yang ikut dalam sidang pembacaan putus perkara tersebut.

Separately, Plt. Head of the Public Relations and Protocol Bureau Budi Wijayanto explained that Anwar Usman's absence was due to the mandate of the Constitutional Court's Honorary Council (MKMK) decision.

"Due to the mandate of the Constitutional Court's decision, His Excellency Anwar is requested not to follow case 141," Budi said, confirmed via text message.

Previously, MKMK confirmed the UNUSIA Student Executive Board (BEM) request not to include Anwar Usman in examining Case Number 141/PUU-XXI/2023.

It is known that UNUSIA students named Tegar Afriansyah and Isfa'zia Ulhaq previously submitted reports of violations of the code of ethics and behavior of constitutional judges to the Constitutional Court.

"The request of the UNUSIA BEM reporter not to include the reported judge in the case examination Number 141/PUU-XXI/2023 can be justified," as quoted from a copy of Decision Number: 2/MKMK/L/11/2023.

Meanwhile, Anwar Usman was sentenced to dismissal from the position of chairman of the Constitutional Court for being proven to have committed a serious violation of Sapta Karsa Hutama while adjudicating Case Number 90/PUU-XXI/2023 regarding the requirements for the age limit for presidential and vice presidential candidates.

The Constitutional Court stated that Anwar Usman violated a number of ethical principles, namely the Principle of Disadvantage, Principles of Integrity, Principles of Skills and Equality, Principles of Independence, and Principles of Rights and Politeness.
