Village Apparatus Delayed Inauguration Of Class Action Lawsuit, Demands Plt Dispermades Kudus IDR 1.39 Billion
JATENG - Prospective village officials (perades) in Kudus are suing group representatives or class action for the letter of ban on the inauguration of those issued by Plt. Head of the Kudus Community and Village Empowerment Service (Dispermades), Djati Solechah.
Budi Supriyanto, the attorney for the candidate for Parades who are members of the Joint Rangking Satu (Garank Satu) Village Apparatus, said his client demanded Djati Solechah of Rp1.39 billion.
"The lawsuit filed by our client, which is a candidate for rank-winning village apparatus (peringkat) one that has not been inaugurated, was submitted to the Kudus District Court on October 19, 2023," Budi said in Kudus, Central Java (Central Java), Monday, October 30, was confiscated by Antara.
According to him, Djati Solechah's actions through a circular ordering the village head not to inaugurate a selection participant for the rank one-winning village apparatus resulted in material and immaterial losses.
In his notes, there are 143 prospective village officials who have not been inaugurated after the result is that they get ranked one in the selection.
A circular issued by Djati Solechah not to inaugurate the village officials selection participants, said Budi, was without the regent's permission.
Meanwhile, the selection of village officials refers to the regent's decree so that without the regent's permission it is certainly not in accordance with the ASN Law.
"Because of this personal action, he was personally sued. Because his actions in issuing a circular on September 11, 2023 resulted in no village head being inaugurated," he said.
In addition to the class action lawsuit (group representatives' lawsuit), his party is also preparing other legal remedies when their demands for inauguration have not yet been realized.
Moreover, he said, the implementation of the selection of village officials requires a budget so that funds sourced from the APBDes must be accounted for.

Previously, there was a letter of agreement with the implementing party for the selection of village officials so that the results of the activities must be carried out. If it is not implemented, according to him, there will be state losses.
The Coordinator of Garannk Satu Intan Permata Dewi revealed that the value of the lawsuit was based on the salary they should have received based on the lowest regional minimum wage (UMR) of Rp. 2.4 million multiplied by 3 months since the Kudus Regent's Decree.
Intan emphasized that her party only demanded his right to obligations carried out by taking the selection exam. According to him, the inauguration should have been based on the regent's decree with the inauguration schedule on March 31, 2023.
However, he said, until October 2023 it had not been implemented. In fact, the regent's decree is a concrete and final individual decision.
"Even though there is a lawsuit, it still cannot hinder the inauguration. That this is the first step in a civil lawsuit. Later, there will be legal remedies again through special and general criminal channels," he said.
Previously, his party together with his friends had tried to have a dialogue with various parties, including an audience with the village head and the sub-district head. However, there has been no common ground until finally legal action was taken.
