3 Political Parties in Penajam, East Kalimantan Submit 3 Files for Replacement Legislative Candidates, One of which is a Former Convict
EAST KAIMANTAN - The General Election Commission (KPU) of North Penajam Paser Regency (PPU) received three required documents for prospective legislative candidates to replace three political parties (parpol). One of the replacement legislative candidates has the status of an ex-convict.
"We received the files of three potential replacement legislative candidates from three political parties participating in the election at the final candidate list (DCT) review stage", said KPUD PPU member, Tono Sutrisno, in Penajam, PPU, East Kalimantan Province (Kaltim), Tuesday 10 October, reported by Antara .
Tono explained that the required files for replacement legislative candidates who are former convicts had been declared complete, including calculating the interval after serving a sentence.
"The participation of former prisoners in elections is regulated in KPU Regulation Number 10/2023", he said.
The regulations state that prospective legislative candidates have never been convicted based on a court decision that has permanent legal force for committing a criminal offense that is punishable by imprisonment for five years or more.
Furthermore, it is not the case that the convict committed a criminal act of negligence and a political crime in the sense that an act is declared a positive legal crime because the perpetrator has a different political view from the regime in power.
Then, for ex-convicts who are candidates for legislative candidates, a period of five years has passed after the convict has finished serving a prison sentence based on a court decision that has obtained permanent legal force.

"We also received the required documents for two potential replacement legislative candidates from two other political parties participating in the election, namely two village heads", he said.
The village head may attach a resignation request at the provisional candidate list stage, but before the DCT is determined, a decision letter (SK) for dismissal as village head signed by the regional head must be attached.
"All the required documents for potential replacement candidates have been received and verification and clarification have been carried out if there are doubtful files before the DCT is determined", said Sutrisno.
