Minister Of Communication And Information: TikTok Is Not Sanctioned Because It Has Been Subsequent To PMSE Regulations
JAKARTA - TikTok officially stopped the TikTok Shop service in Indonesia as of October 4 at 17.00 WIB. Through this decision, the Minister of Communication and Information Budi Arie Setiadi stated that no sanctions would be given to TikTok.
"Regarding Tiktok Shop, Tiktok has made the decision to no longer facilitate transactions on the TikTok Shop platform. In this case, sanctions against TikTok are not necessary considering Tiktok has complied with Electronic System (PMSE) Trading Regulations," Budi said in his official statement.
However, Budi emphasized that Kominfo will continue to evaluate and coordinate with the relevant sector ministries to ensure PSE compliance with existing regulations.
In accordance with Law Number 11 of 2008 concerning Information and Electronic Transactions and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE), the Ministry of Communication and Informatics carries out its supervisory function against Electronic System Operators (PSE).

Kominfo also has the right to impose sanctions on PSEs that violate regulations, including termination of access in accordance with requests from relevant ministries and institutions, after evaluating/coordinating with the request.
In the context of enforcing the law for the implementation of PMSE, the Ministry of Communication and Informatics carries out the PSE's supervisory function through routine monitoring activities of all digital platforms that provide e-commerce services.
Not to forget, Kominfo urges digital economy players who have been using social commerce platforms as a means of PMSE, to take advantage of existing marketplace platforms, as well as through other online transaction media while still prioritizing transaction reliability and security aspects.
