2 Defendants Of Corruption In The Babakan Health Center Capitation Fund Sued 6 Years And A Fine Of Rp. 200 Million
MATARAM - Two defendants in the alleged corruption case in the management of capitation funds for the 2017-2019 period at the Babakan Health Center, Mataram City, West Nusa Tenggara, were each sentenced to 6 years in prison by the public prosecutor.Sesarto Putera, who represented the public prosecutor, read out the demands of the two defendants, also asked the panel of judges to impose a fine of Rp. 200 million, subsidiary to 4 months in prison."Demanding that the panel of judges declare the defendants one Raden Hendra and Ni Wayan Yuniarti guilty of committing a criminal act of corruption together as in the primary indictment of the public prosecutor," said Sesarto before the Panel of Judges at the Mataram District Court, Antara, Thursday, July 20.The primary indictment relates to Article 2 paragraph (1) Juncto Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code jo. Article 64 paragraph 1 of the Criminal Code.The prosecutor demanded this by stating that the actions of the two defendants had been proven against the law by enriching themselves, others, and/or a corporation, causing state losses of Rp. 690 million in accordance with the results of the audit by the NTB Financial and Development Supervisory Agency (BPKP).In addition to demanding a crime, the prosecutor asked the panel of judges to stipulate that the two defendants pay compensation for state losses in the amount of Rp483 million for the defendants Raden Hendra and Rp207 million for the defendant Yuniarti.If they are unable to pay within a period of 1 month from the time the decision has permanent legal force, then his party will confiscate and auction off the assets belonging to the two defendants to cover the compensation for state losses."If property is not sufficient to compensate the state for losses, then the two defendants must replace it with imprisonment for 2 years and 8 months in prison," he said.In the description of the charges, the prosecutor also conveyed a number of facts that revealed that the two defendants had committed a criminal act of corruption.For the defendant Raden Hendra, who plays the Head of the Babakan Health Center, it was revealed that he borrowed money from the management of capitation funds."The loan revealed that the defendant Raden Hendra had not made a return. The money was used for the defendant's personal interests," said Sesarto.
In addition, the defendant Raden Hendra and the defendant Yuniarti, who played the role of treasurer, cut in the process of disbursing capitation funds.
