Bali Police Corrects Kapolda's Statement Regarding Criminal Threats To Viralize Naughty Foreign Tourists
DENPASAR - Bali Regional Police have clarified the ban on the Bali Police Chief Inspector General Putu Jayan Danu Putra to post delinquency of foreigners on social media only with pornography because it could lead to threats from the ITE Law.
The Head of Public Relations of the Bali Police, Kombes Stefanus Satake Bayu Setianto, said that the criminal threat of the ITE Law was applied to anyone who spreads videos, only those containing pornographic and pornographic elements, while posting delinquency of foreigners who do not contain pornography is not prohibited.
"We need to clarify that what is meant is intentionally or unintentionally spreading, posting pornographic and pornographic videos on social media," he said as quoted by ANTARA, Monday, May 29.
Satake gave an example of the ban on the spread of viral videos of foreigners without clothes (bugil) during the performance of Balinese dance at Puri Saraswati Ubud, Gianyar and videos of a pair of foreigners having sex at the edge of a swimming pool, as well as videos containing elements of pornography and other pornography can be prosecuted in accordance with the ITE Law.
"So what was meant yesterday by the Kapolda, there are matters related to wanting to report and on the one hand it is also allowed to report through social media. However, do not violate the applicable rules. For example, pornography should be reported through the Polda or Polres, so we follow up because if pornography is viral it will also be punished," said Satake.

According to him, in addition to violating the ITE Law, these content can also have a negative impact on the psychology of people watching, especially minors.
"We hereby need to convey that the Bali Police Chief's statement is intended to provide socialization and education to the public that the ITE Law is a control tool for the public in creating creative content," said Satake.
Satake explained that in addition to pornography and pornography, the ITE Law also regulates decency, defamation, or insults, threats and extortion, as well as fraud (illegal access) that utilizes social media.
As for content that may go viral in the context of community control functions and this is not a problem in the ITE Law, such as problems in the community in the form of cases that need special attention from the Police or the government such as corruption, gambling, damaged roads or schools, burglary, extortion, disturbances from Kamtibmas or other injustices.
"Especially for Pornography and Pornaction of the ITE Law, it has regulated that the perpetrators of video makers and those who spread or viralize can be subject to criminal sanctions," he said.

Therefore, Satake requested that if there are people who know that pornography or pornography and other immoral acts have occurred, they immediately report without having to go viral through social media because the law in Indonesia has regulated this, such as the Criminal Code, the Pornography Law and the Child Protection Law.
