The Rationality Of Detention In The Case Of Lucinta Luna Through A Health Approach
JAKARTA - The arrest of Lucinta Luna adds to the long list of problems for artists who are entangled with drugs. The Community Legal Aid Institute (LBHM) views the problem of using narcotics should use a health perspective, not just a form of punishment in a criminal case.
Previously, the West Jakarta Metro Police arrested a person known as "celebgram" Lucinta Luna last Tuesday (11/2). He was named a suspect after his urine test was positive for psychotropic substances.
This evidence is strengthened by the discovery of seven items of Tramadol and five points of Riklona which belong to the psychotropic class, and three ecstasy pills (narcotics class I).
The police said Lucinta Luna would be detained in a special cell at Polda Metro Jaya. Reportedly the police will detain him for the next 20 days and may be extended if necessary.
LBHM Director Ricky Gunawan assessed that the actions taken by the police were contradicting the efforts to support the recovery of a narcotics user. The police should prioritize a health approach.
Because it can also be seen from Lucinta Luna's own confession, who said that the reason she used narcotics was to get rid of depression. Lucinta Luna admits that she has difficulty controlling her emotions. There are indications that he has attempted suicide several times.
"From the start, the West Jakarta Police should be able to involve health workers, such as psychiatrists or psychologists, and immediately diversify Lucinta Luna to a health service facility," Ricky told VOI, Friday, February 14.
According to Ricky, the diversion from crime to health is intended so that Lucinta Luna can continue to access her health, both for cases of narcotics use and mental health.
It is undeniable that Lucinta Luna's arrest will of course invite sensational media coverage and disturb the privacy of the person concerned. In addition, the West Jakarta Police made the situation even worse by disclosing facts that had nothing to do with the subject matter, such as the identity of Lucinta Luna's partner.
"The facts above show that the criminal approach the police use only worsens the stigma against drug users, people with mental problems, and transgender groups," said Ricky.
He also argues that the police beat the average drug users who actually have various backgrounds to become only one identity, namely as criminals.
"It is time for the police to stop using punitive methods in overcoming the problem of narcotics use, and to prioritize a humane health approach," he concluded.
Drug supplier to Lucinta Luna
The development of the narcotics abuse case that ensnared Lucinta Luna began to get new findings. The illicit drug supplier, IF Alis FLO, is known to use official prescriptions to obtain Riklona and Tramadol.
Head of Public Relations of Polda Metro Jaya Kombes Yusri Yunus said that the prescription for hard drugs was obtained from one of the doctors at the hospital in Jakarta. However, it is not yet known how the IF alias FLO can get the doctor's prescription.
"We understand where to get Rikolna, (recognition of IF aka FLO) is indeed a prescription from a doctor from a hospital in Jakarta," said Yusri in Jakarta.
From the examination it was known that IF aka FLO had supplied illegal drugs to Lucinta Luna three times. In fact, from his confession, the drug given to celebrities was not only one type. Instead, according to the recipe he got.
In addition, to investigators, IF aka FLO also admitted that the drugs given to Lucinta Luna were intended to be able to sleep soundly and relieve depression.
However, the investigators still stated that the actions of IF alias FLO and Lucinta Luna were violations of the law because the use of strong drugs must be under the supervision of a doctor.
"Obviously there is a violation, it is not given free of charge because the doctor's prescription is a strong drug," said Yusri.
From the drug order, IF aka FLO got a wage of around Rp. 500 thousand from Lucinta Luna. In fact, when he was arrested, the police found dozens of Riklona items from his residence. So, there are allegations if he also supplies to other people.
However, to confirm this allegation, investigators are currently studying the information from the IF alias FLO, including examining the doctor who gave the prescription drug.
"Doctors who give or issue prescriptions will also be examined to explore a number of things," said Yusri
Apart from that, the results of the examination also revealed that IF aka FLO is also transgender. He is a man who changes his identity to become a woman.
Not much different from Lucinta Luna, IF aka FLO has also been recognized by the state as a woman. In fact, the request for a change of identity had been submitted to the Sumedang District Court several years ago.
"Around 2015, the court received a request for a change of identity from the person concerned. So, she is a woman who is recognized by the state," said Yusri.
