Tangerang Prosecutor's First Restorative Justice 2023: Persecution Case With 2 Defendants
TANGERANG - The Tangerang City District Attorney (Kejari) has completed a case of persecution with the defendants Jopie Amir bin Alm Amirudin and Pabuadi bin Alm Susmono in a restorative justice manner. Between the defendant and the victim has declared peace.
"It is recorded that this will be the first restorative justice for the Tangerang City District Attorney's Office in 2023, and is an achievement for the Tangerang City Prosecutor's Office," said Head of Tangerang City Prosecutor's Office, I Ketut Maha Agung in Tangerang, Wednesday, April 5, as reported by Antara.
I Ketut said that today he held a letter of termination of prosecution based on restorative justice related to the case in question.
He said, in this case there had been a minor crime of persecution, as referred to in Article 351.
With this, based on restorative justice, the Head of the Tangerang City Prosecutor's Office issued a decree Number: B -1619 / M.6.11 / Eoh.2 / 03 / 2023.
As for the reason for giving the termination of prosecution based on restorative justice, I Ketut explained that it was the first time the defendant had committed a criminal act or had never been convicted and the threat of a fine or imprisonment was no more than five years.
"A peace process has been carried out in which both parties have forgiven each other, promised not to repeat their actions, peace was carried out voluntarily by deliberation, without pressure, coercion and intimidation," explained I Ketut.
Meanwhile, Jopie Amir bin Alm Amirudin expressed his gratitude for the bright spot in his case. The reason is, before there is no midpoint, but in the hands of the Tangerang City Prosecutor's Office, a family atmosphere can be built so that it becomes a restorative justice decision.
"I personally am happy and grateful for the creation of this restorative justice. In the process, it is very friendly, we have both communicated with each other and hopefully we can both live in the future with kinship," said Jopie.

Meanwhile, the other defendant, namely Pabuadi, also expressed his appreciation to the Tangerang Kejari because the case was over.
"I hope that restorative justice will not only be felt by both of us, but can be felt by more residents through the Tangerang City District Attorney," he said.
The chairman of the Tangerang City DPRD, Gatot Wibowo, stated that this was a good step in the good month, namely Ramadan. Through the Tangerang City District Attorney's Office, a peace can take place between the two parties.
"I appreciate this restorative justice, hopefully it can be an example for other cases, and be a spirit for the ranks of the Prosecutor's Office to prioritize peace in cases that can be resolved in restorative justice," he said.
