Regarding Mardani Maming's Pretrial Matters, Denny Indrayana: Control Form And Forced Correction Of Cases
JAKARTA - The lawyer for former Tanah Bumbu Regent Mardani H. Maming, Denny Indrayana, said the pretrial submitted to the South Jakarta District Court related to allegations of bribery and gratification was a form of control and correction. Moreover, this case was allegedly ordered by another party.
"The pretrial is clearly an instrument of procedural law and a means of control for the ongoing process at the KPK, as well as correction of the substance of the case that was forced or ordered by the interests of the seizure of business," said Denny in a written statement to reporters quoted on Friday, July 14.
This case was allegedly ordered because Mardani's business wanted to be seized by another businessman, namely Syamsuddin Arsyad alias Haji Isam who came from South Kalimantan.
Furthermore, Denny also said that the KPK had misunderstood the pretrial submission process by saying that there was no subject matter being tested. According to him, in this process, the strength of the initial evidence to ensnare his client will also be a concern.
Moreover, in the law, to determine a person as a suspect must be accompanied by sufficient preliminary evidence. "The decision must be accountable before the law," said the former Deputy Minister of Law and Human Rights (Wamenkumham).
"Especially for special crimes of corruption handled by the KPK," he said.

As previously reported, Acting Spokesperson for the KPK for Enforcement, Ali Fikri, emphasized that the pretrial process proposed by Mardani did not stop the ongoing investigation.
He appreciated the ongoing pretrial process. However, Ali reminded that the legal effort was not to examine the subject matter of the alleged bribery and gratification that ensnared Mardani.
"Pretrial is not an arena to examine the main material of the investigation process of this case," said Acting Spokesperson for the KPK for Enforcement, Ali Fikri, to reporters, Thursday, July 14.
"Regarding the subject matter of the case, let us examine it together in front of the panel of judges in the corruption court," Ali continued.
For information, Mardani Maming was said to have received IDR 89 billion in money in a trial for alleged bribery for a mining business permit (IUP) in Tanah Bumbu Regency which was held at the Tipikor Court, Banjarmasin, South Kalimantan (Kalsel).
This allegation was conveyed by the younger brother of former President Director of PT Prolindo Cipta Nusantara (PCN) Henry Soetio, Christian Soetio. At that time, Christian claimed to know that there was a flow of funds to the former Regent of Tanah Bumbu Mardani H Maming through PT Permata Abadi Raya (PAR) and PT Trans Surya Perkasa (TSP).
The money transfer has been going on since 2014. The amount of tens of billions of rupiah is referred to as the amount quoted based on PT PCN's financial statements.
