Judge Sentences Managing Director Of Gili Air Lombok Jetty Project 1 Year In Prison
MATARAM - The panel of judges sentenced the director of the company to implement the dock construction project in the tourist area of Gili Air, North Lombok, West Nusa Tenggara, Suwandi with a sentence of 1 year in prison.
"I hereby declare that the defendant Suwandi jointly committed a criminal act of corruption by imposing a 1-year imprisonment and a fine of IDR 50 million", said Chief Justice I Ketut Somanasa reading Suwandi's decision at the Mataram Corruption Court, reported by ANTARA, Friday, June 24.
If the Director of PT Gelora Megah Sejahtera is unable to pay the criminal fine within a period of 1 month from the status of the decision having permanent legal force, the judge stipulates that the defendant should replace it with imprisonment for 1 month.
The judge handed down such a decision by stating that the defendant's actions were proven to have violated the subsidiary indictment, namely Article 3 Jo Article 18 of the Republic of Indonesia Law Number 20/2001 concerning Amendments to RI Law Number 31/1999 concerning the Eradication of Corruption Crimes, Jo Article 55 paragraph 1 Ke -1 of the Criminal Code.
One of the judges' considerations in making the verdict lower than the demand for 1 year and 6 months in prison and a fine of IDR 50 million, subsidiary to three months in prison, was the refund of the cost of borrowing the company flag which was received from another defendant, namely Edi SA Rahman, worth IDR 40 million.
However, the IDR 40 million that Suwandi had deposited with the prosecutor at the investigation stage and confiscated to be used as evidence in this case, the judge emphasized that this did not erase the defendant's criminal actions.
"Therefore, the return (of money) is calculated as the defendant's efforts in recovering state losses", he said.
The emergence of losses from the dock construction project in the Gili Air tourist area at the Department of Transportation, Maritime Affairs, and Fisheries of North Lombok Regency in 2017 with a contract value of IDR 6.28 billion was proven by a construction expert study.
It was found that there was a lack of work volume with a compensation value of IDR 98.138 million and an overpayment of three items, valued at IDR 684.238 million, bringing the total loss to IDR 782 million.

The defendant Suwandi in this project gave the power of attorney to work on the project to another defendant, Edi SA Rahman. In the description of the verdict, it was revealed that Kelvin received the project money from Edi SA Rahman.
The receipt of IDR 40 million from Edi SA Rahman for the cost of borrowing the company's flag resulted in him being jointly involved in committing a criminal act of corruption with other defendants.
