Emirsyah Satar Is Mentioned In Garuda ATR 72-600 Aircraft Procurement Case, Legal Counsel BPKP Audit Value As Unclear: Would Be Good To Be Proved First

JAKARTA - The attorney for former President Director of PT Garuda Indonesia Emirsyah Satar, Afrian Bondjol said that the investigative audit conducted by the Financial and Development Supervisory Agency (BPKP) related to the alleged corruption in the procurement of the ATR 72-600 Garuda aircraft did not clearly state who should be responsible for this. that case.

However, said Afrian, in the alleged corruption case, the name Emirsyah Satar was made as if he was responsible for the alleged corruption case in the procurement of the aircraft.

"Based on the BPKP investigative audit report on the procurement of ATR 72-600 aircraft at PT Garuda Indonesia (Persero) Tbk, it does not clearly state who should be responsible for the alleged corruption," he said at a press conference, in Jakarta, Monday, January 17th.

Furthermore, Afrian asked for BPKP audit statements which stated that the corruption case in the procurement of the ATR 72-600 aircraft occurred where the leadership of Emirsyah Satar had to be proven first.

"Because in carrying out their duties, the board of directors is authorized to carry out management in accordance with policies that are deemed appropriate, within the limits determined by the Company Law and/or the company's AD," he explained.

Afrian assessed that there was an opinion movement that occurred in the mass media as if Emirsyah Satar was the perpetrator in the case. However, this case is still under investigation by the Attorney General's Office.

"The Attorney General of the Republic of Indonesia is still in the stage of seeking information and evidence to carry out an in-depth investigation of the alleged corruption in Garuda by prioritizing the principle of presumption of innocence," he said.

Afrian explained, the procurement process for the ATR 72-600 aircraft was held by PT Citilink Indonesia as a subsidiary of Garuda. Furthermore, PT Garuda Indonesia took over because ATR and the lessor asked for guarantees from the state-owned airline.

According to Afrian, the takeover of the procurement of the ATR 72-600 aircraft was not only approved by Emirsyah Satar, but also the President Director of Garuda Indonesia at that time. However, he said, there were other parties involved in the process of diverting the plane from Citilink Indonesia.

"Our client has received approval from the board of directors and board of commissioners meeting which confirms the first point that our client strongly puts forward the principles of good corporate governance and prudence in accordance with the authority as written in the articles of association of PT Garuda Indonesia Persero Tbk and in accordance with applicable legal provisions. happens," he explained.

Not only that, said Afrian, the procurement of the ATR 72-600 aircraft is also a purely business decision for the benefit of the Indonesian state by referring to the company's budget work plan and the company's long-term work plan.

"That the policy for the transfer of the ATR 72 603 aircraft is inseparable from the government's program related to the master plan for the acceleration of Indonesia's economic development in 2011-2025 MP3EI," he said.
