Highlights Adelin Lis' Verdict, Criminal Law Expert: Not Criminal Entering Administrative Violations

JAKARTA - Criminal law expert from Al-Azhar University highlighted the verdict handed down to Adelis Lin in the case of alleged illegal forest logging. The main problem in that case is considered only an administrative matter.

Adelin Lis is the owner of PT Mujur Timber Group and PT Keang Nam Development Indonesia who was convicted in the illegal logging case in the forest of Mandailing Natal, North Sumatra.

The Medan District Court acquitted Adelin Lis in 2007. However, the Attorney General's Office filed an appeal and in 2011.

The Supreme Court granted the appeal. Thus, Adelin Lis was sentenced to 10 years in prison and a fine of Rp. 1 billion because he was found guilty of corruption.

"Adelin Lis's violation was an administrative error, not a criminal case," said Suparji in a discussion entitled 'Annotation of Adelin Lis' Decision which was held atELaz Kafe, Kebayoran Baru, quoted on Saturday, November 11.

The view of the main problem is included in the administrative category because the logging location is still within the HPH/IUPHHK permit area of PT KeangNam. So, it cannot be prosecuted criminally.

In addition, Suparji also advised Adelin Lis to submit a second review (PK). Thus, it can prove that there was an error in the decision that was suspected.

"The timber felling carried out still includes the location area of the company's license, so it can apply for another PK with the argument of administrative violations, this will prove the judge's mistake," he said.

"That's why in the PK later, it must be completely complete. So, it can prove there is a contradiction to the judge's decision, whether it has the potential to be granted depending on the arguments of the PK," he continued.

In addition, Forestry Law Expert and Lecturer at the Faculty of Law, Al Azhar University, Sadino said he deeply regretted the use of criminal proceedings in the Adelin Lis case. Because, from his perspective, no state losses were caused.

"There are violations committed by administrative errors, this is what makes them wonder why it has to be a criminal act, especially since Adelin Lis has not been proven to be detrimental to the state, it must be clear what state losses are caused by Adelin Lis," said Sadiono.
