JAKARTA - Chairman of the Witness and Victim Protection Agency (LPSK) Hasto Atmojo Suroyo hopes that the panel of judges will be proactive regarding the cost of compensation or restitution of the defendant in the persecution case, Mario Dandy.

"It is possible for a defendant to declare that he is unable and so on, but we hope that the judge will also behave or think and also be proactive for the benefit of the victim," said Hasto as quoted by ANTARA, Monday, August 7.

Hasto said LPSK had tried to carry out a maximum assessment in recording the restitution submitted to Mario Dandy. LPSK has included the losses suffered by the victim, David Ozora.

LPSK has tried to assess as much as possible and include the losses suffered by the victims that can be proven. "Because if it can't be proven, it's difficult for us to apply for this (restitution)," he said.

He also said that Mario Dandy's restitution decision was entirely in the hands of the judge. Therefore, he asked the panel of judges who tried the case to think about the interests of the victim.

"It is in the hands of the judge. Judge, we hope, if possible, yes, decide something progressive for the benefit of this victim," he said.

Hasto said Mario Dandy could be sentenced to a substitute sentence if the restitution was not paid. However, he assessed that the substitute was too light and was not commensurate with the victim's loss.

"Yes, it could be that the judge decided to give a subsidiary sentence, but the subsidiary's punishment is that according to the law it is very light," said Hasto.

Therefore, Hasto hopes that the panel of judges can track down the assets of Mario Dandy's family to pay for the restitution.

"You can't just say you can't afford it, but it must be proven if you can't afford it," he said.

Previously, the Head of the LPSK Restitution Calculation Team Abdanov Jopa was a witness in the trial of the persecution case of the defendant Mario Dandy at the South Jakarta District Court, Tuesday (20/6).

During the trial, Abdanev filed a restitution of Rp120 billion for the persecution of David Ozora.

On the other hand, Mario Dandy Satriyo's attorney, Andreas Nahot Silitonga, said that all of his client's assets could be confiscated to pay compensation or restitution for the victim's medical expenses, David Ozora.

"So all Mario's assets on behalf of him could be confiscated for the auction to pay the restitution," Andreas told reporters at the South Jakarta District Court, Thursday (15/6).

Andreas said Mario's condition was still a student and had not yet worked, so the restitution stage was not yet known if it was granted.
