BEM Unusia Urges MKMK Not To Involve Anwar Usman In The Trial Of The Presidential-Cawapres Age Limit Lawsuit

JAKARTA - The Student Executive Board (BEM) of the University of Nahdlatul Ulama Indonesia (Unusia) asked the Honorary Council of the Constitutional Court (MKMK) not to include Chief Justice of the Constitutional Court Anwar Usman in the case judicial review session Number 141/PUU-XXI/2023.

The trial regarding the age requirements for the presidential and vice presidential candidates to run for the presidential election is scheduled to be held on Wednesday, November 8.

"We ask His Majesty not to include Anwar Usman in the case so that there is no repeated violation of conflicts of interest within the Constitutional Court," said the representative of BEM Unisia as well as the reporter for alleged violations of the code of ethics of the Constitutional Court judge, Tegar Afriansyah, at the Constitutional Court II Building, Jakarta, Thursday 2 November, confiscated by Antara.

Tegar said Anwar Usman was strongly suspected of committing a violation in the form of a conflict of interest against the Constitutional Court's Decision Number 90/PUU-XXI/2023. Thus, the complainant assessed that Anwar should not be included in the trial of the case.

Furthermore, Tegar hopes that MKMK can impose severe sanctions related to alleged violations of the constitutional judge's code of ethics, namely by dishonorably dismissing Anwar Usman from his position as chairman of the Constitutional Court.

"We ask Your Excellency the Honorary Council of the Constitutional Court to give the most severe sanctions in the form of disrespectful dismissal to Chief Justice of the Constitutional Court Anwar Usman," said Tegar.

The lawsuit against Case Number 141/PUU-XXI/2023 was filed by an Unusia student named Brahma Aryana who requested a judicial review of Law Number 7 of 2017 concerning General Elections (Pemilu) regarding the age limit for presidential candidates (candidates) and vice presidential candidates (cawapres).

In this case, the applicant requested that the Constitutional Court correct the Constitutional Court's Decision Number 90/PUU-XXI/2023 which stated that the nomination requirements for presidential and vice presidential candidates were changed to the lowest age of 40 years or experienced as regional heads at both provincial and district and city levels.

The petitioner requested that the Constitutional Court change the phrase "experiencing as a regional head both at the provincial and district and city levels" to "only experience as a regional head at the provincial level".
