This Meaning 'Not 40 Years But Having Experience To Become A Regional Head' Can Run For Cawapres 2024
JAKARTA - The Constitutional Court (MK) has granted the claim that the presidential and vice presidential candidates are not yet 40 years old or have "experiencing" to become regional heads can run in the 2024 presidential election.
The Constitutional Court said it was important to consider the meaning, "have experience or experience" as regional heads, as a reason the age requirement is meant for those who register as presidential and vice-presidential candidates.
The meaning is explained by Constitutional Justice Daniel Yusmic Pancastaki Foekh regarding the Constitutional Court's decision regarding the lawsuit of Article 169 letter q of Law (UU) Number 7 of 2017 concerning Elections regarding the minimum age limit for presidential and vice presidential candidates proposed by a student named Almas Tsaqibbirru Re A.
"The Court has also given principal considerations stating that a person has served as a regional head or regional head official for half or more of his term of office, so the person concerned is calculated to have served one term (VIde Decision of the Constitutional Court Number 22/PPU-VII/2009 which was pronounced in an open session to the public on November 17, 2019]," Daniel said in a trial at the Constitutional Court's decision, Monday, October 16.
Then, Daniel revealed that the Constitutional Court emphasized that the term of office that has been served by half or more is the same and does not distinguish between "the term of office that has been served", both those who serve as definitively and interim officials. This is in accordance with the Constitutional Court's Decision Number 67/PPU-XVIII/2021.
However, in the context of the requirements to become presidential and vice-presidential candidates regarding the meaning of "have experience or experience" as regional heads, Daniel said it must be interpreted proportionally that the person concerned is prioritized to complete his duties and authorities as governor at least once in full term, which is 5 years.
"This is intended to prevent the emergence of candidates from Regional Head Officials (Governor Officials) who are determined based on the appointment mechanism, not elected officials," he said in response to case Number 90/PUU-XXI/2023.
