Supreme Court Cassation Decision Relieves Sentence Of 2 Drug Case Defendants In Ambon

The Supreme Court's cassation decision eased the prison sentence for Cahiril Anwar Tuanaya and Iskandar Rolobessy in a drug case.

"MA granted the appeal that we submitted as legal counsel and a decision for Chairil for 1.5 years in prison for a fine of Rp. 800 million, subsidiary to one month in prison," said the defendant's legal adviser, Dino Huliselan in Ambon, as reported by ANTARA, Thursday, July 20.

According to him, in the appeal decision of the Ambon High Court number 144/PID.SUS/2022, the defendant Chairil was sentenced to 2.5 years in prison for a fine of Rp800 million, subsidiary to one month in prison.

In the first instance court, the Ambon District Court judges sentenced the defendant Chairil to four years and a fine of Rp. 800 million, subsidiary to four months in prison.

Then the prison term for the defendant Iskandar Rolobessy, which was decided by the Supreme Court, fell to 3.5 years after being sentenced to five years and six months in prison and a fine of Rp. 1 billion, subsidiary to two months in prison at the end of 2022.

"The decision of the Ambon District Court judges last year was heavier than the demands of the Maluku Attorney General's Office, Senia Pentury, who demanded the defendant to be in prison for 1.5 years and a fine of Rp. 800 million, subsidiary to six months in prison," explained Dino.

He said the high decision of the Ambon District Court judges was felt too heavy from the prosecutor's demands and the evidence was in the form of two packages of narcotics class one, not methamphetamine plants weighing below gram.

"That's why we as legal advisers made an appeal to PT Ambon and appealed to the Supreme Court of the Republic of Indonesia and granted it," he said.
