JAKARTA - The South Jakarta District Court has postponed the trial of the pretrial lawsuit filed by the inactive Papua Governor Lukas Enembe to the Corruption Eradication Commission (KPK) for a week.
"Okay, we postponed it for a week, on April 17, 2023 we summoned the KPK respondent," said South Jakarta District Court Single Judge Hendra Utama Sutardodo at the South Jakarta District Court, Antara, Monday, April 10.
The postponement of the pretrial lawsuit trial was the result of the absence of the KPK at the inaugural trial which was held today.
Separately, Lukas' lawyer, Petrus Bala Pattyona, explained that the KPK could not attend because it had to coordinate in preparing administration and materials to deal with pretrial applications.
"The point of the letter is like this, the KPK has received a pretrial summons for Mr. Lukas Enembe. Today, according to the letter, he stated that he could not attend because the narrative presented by the KPK had to coordinate, prepare administration and materials to deal with pretrial applications,” said Petrus.
The KPK as the respondent asked for a 3 week postponement of the trial. However, Petrus is of the view that the duration of the postponement of the trial requested by the KPK is too long.
"Regarding the KPK's application, in our opinion, the KPK is a very strong institution. If the KPK asks for 3 weeks to coordinate, administration, prepare answers, this is really strange," said Petrus.
Petrus actually proposed a delay of 3 days. However, the sole judge decided to postpone it for a week.
"So, the KPK's 3 weeks application was rejected, the judge only ignored it for 1 week, so the trial was back on April 17,” he said.
The lawsuit filed by Lukas Enembe on Wednesday (29/3) was filed in relation to whether or not the KPK had determined the suspect.
In his petitum, Lukas Enembe asked the judge to declare the Investigation Order Number Sprin.Dik/81/DIK.00/01/09/2022, dated September 5, 2022, which named himself a suspect in bribery and gratification by the KPK is invalid and not based on law.
In his lawsuit, Lukas Enembe also asked to be held as a city prisoner and expelled from the KPK detention center.
Previously, the KPK said that it was ready to face the pretrial lawsuit filed by the inactive Papua Governor Lukas Enembe.
"Of course the KPK is ready to face the pretrial," said Head of the KPK News Section Ali Fikri in Jakarta, Saturday (1/4).
Ali said that the KPK really appreciates the request as a control process in handling cases by the KPK, especially in terms of the formal aspect of case settlement.
"We have complied with the formal requirements in this case so that in turn we are optimistic that the request for a pretrial lawsuit for the suspect will be rejected by the judge," he said.
