DKI Regional House of Representatives Agrees With Anies' Proposal To Add Criminal Sanctions For Prokes Violators And Satpol PP Can Become Investigators

JAKARTA - Chairman of the DKI Jakarta Regional House of Representatives, Prasetyo Edi Marsudi, said the council approved the proposal of the Governor of DKI Jakarta Anies Baswedan regarding changes to several articles in Regional Regulation Number 2 of 2020 concerning COVID-19 Response.

In his proposal, Anies asked Civil Service Police Unit to be given the authority to investigate violations of health protocols. Then, Anies also wants additional criminal sanctions for people who do not wear masks and businesses violate health protocols.

"The DKI Jakarta Regional House of Representatives has agreed to strengthen the rules regarding the obedience of all parties in complying with activity restrictions and health protocols", he said on the @Prasetyoedimarsudi Instagram account, quoted Wednesday, July 21.

Prasetyo said several clauses in the rules were added and changed to make them stronger, especially in threatening sanctions for each violation, starting from the top to the bottom.

"This regional regulation revision is an emergency, for the sake of humanity, for health, and the safety of people's lives", said Prasetyo.

Therefore, Prasetyo said that all factions in the DKI Regional House of Representatives agreed to approve the proposal.

"Therefore, in the leadership meeting with all factions in the DKI Jakarta Regional House of Representatives we agreed to amend the Local Regulations", he said.

It is known that in the draft document for the amendment to the regional regulation received by VOI, Anies slipped one article between Articles 28 and 29, namely Article 28A.

This article contains rules regarding the investigation of violators of the PPKM provisions. In addition to the article, Anies wants DKI State Civil Apparatus (ASN) such as the Civil Service Police Unit to have the authority as investigators.

This means that this investigator is authorized to receive reports, conduct examinations, ask for information and evidence, examine the identification of people suspected of violating the rules, take fingerprints, take pictures and provide the results of investigations to the police and district courts to determine criminal penalties.

Furthermore, Anies also added two articles between Articles 32 and 33, namely Articles 32A and 32B. This article adds a criminal threat.

He explained, if there are violators who repeat the act of not wearing a mask after being given social and administrative work sanctions, they will be sentenced to a maximum of three months in prison or a maximum fine of IDR 500,000.

Furthermore, for business actors such as offices, industry, hotels, transportation, and restaurants who repeat acts of violating health protocols and have received a license revocation, they will be sentenced to a maximum imprisonment of three months or a maximum fine of IDR 50,000,000.
