DENPASAR - Denpasar District Court received a pretrial application registration related to the alleged reclamation case of Melasti Beach, Ungasan, Badung, Bali. Two applicants were named as suspects by the Bali Police.

Denpasar District Court Spokesman Gede Putra Astawa said the two people who had made pretrial efforts against the status of the suspect were Bendesa/Head of Traditional Village Ungasan I Wayan Disel Astawa (52) and Gusti Made Kadiana (58).

The two pretrial applicants registered the case on June 6, 2023.

Pretrial submission by I Wayan Diesel Astawa is registered with register 15/Pid.Pra/2023/PN Dps. Meanwhile Gusti Made Kadiana with registration number 16/Pid.Pra/2023/PN Dps.

"The trial for Disel Astawa is led by Single Judge Yogi Rachmawan. Meanwhile, Made Kadiana is led by Single Judge I Putu Agus Adi Antara. The schedule for the second trial is June 20, 2023," said Astawa as quoted by ANTARA, Friday, June 9.

Astawa explained in the report that both of them were mentioned as applicants. Meanwhile, the respondent is the Bali Police Chief Inspector General Pol. Putu Jayan Danu Putra cq Director of General Criminal Investigation of the Bali Police.

said that his party had received information regarding the pretrial lawsuit. Satake also stated that the lawsuit is the right of everyone to be treated equally before the law.

To deal with the pretrial lawsuit, the Bali Police have prepared a legal team.

Satake said the pretrial was aimed at upholding the law and protecting the suspect's human rights.

"The pretrial is the right of everyone who aims to uphold the law, legal certainty and protection of the suspect's human rights and also as control of the police as well. That's normal in criminal cases," said Satake.

Satake also stated that the determination of five suspects in the alleged reclamation case of Melasti Beach in Ungasan, Badung Regency, Bali was in accordance with legal procedures in accordance with stages from investigation to investigation until finally naming a suspect.

The five suspects in the alleged reclamation of Melasti Beach were GMK (58), MS (52) IWDA (52) as the Ungasan Traditional Bendesa, KG (62), and T (64). According to Satake Bayu's statement from the five suspects, the two suspects acted as permittrants and three other suspects helped the illegal reclamation process.

The five suspects were charged with multiple articles. The article that ensnared the five suspects was Article 75 in conjunction with Article 16 of Law Number 1 of 2014 concerning amendments to Law no. 27 of 2007 concerning Coastal and Small Islands Management in conjunction with Law no. 11 of 2020 concerning job creation in conjunction with Article 56 to 1 e of the Criminal Code with a threat of three years in prison or a fine of IDR 500 million.

Second, Article 109 in conjunction with Article 36 paragraph 1 of Law no. 32 of 2009 concerning Management and Environmental Protection in conjunction with Law no. 11 of 2020 concerning job creation with a maximum penalty of three years, a fine of at least Rp. 1 billion at most Rp. 3 billion.

Third, Article 69 in conjunction with Article 61 A of Law no. 26 of 2007 concerning spatial planning in conjunction with Law no. 11 of 2020 concerning job creation with a maximum penalty of three years and a fine of IDR 500 million.

According to Satake's statement, the fifth was not detained by the Bali Police because of the threat of a sentence of under five years in prison.
