Debt Bill, Debt Collector Seizes Pregnant Mother's Car
MATARAM - A woman reported to the Mataram City Police, West Nusa Tenggara because her car, a black Suzuki APV, was seized by two debt collectors. The Mataram Police Puma team moved quickly and immediately arrested two debt collectors.
Referring to the mother's report, this incident occurred when her car was passing on Jalan Bung Karno, Mataram City. The mother admitted that her car was forcibly taken while passing by.
Reporting from Antara, October 22, the victim admitted that he had just made a car installment payment to a financial company. Then the two perpetrators came to the victim by blocking the road.
"The two perpetrators admitted that they were only ordered by a financial company. The reason was that the victim was still in arrears in credit deposits. The victim could not pay and eventually the car was taken by the two perpetrators," said Head of Criminal Investigation Unit of the Mataram Police, AKP Kadek Adi Budi Astawa.
"So they were both arrested because the handover of the car by the victim was not carried out according to procedures," continued Kadek Adi.
The procedure, he said, was seen from the latest decision of the Constitutional Court (MK) Number 18 / PUU-XVII / 2019. It stated that a finance company or "leasing" could not unilaterally confiscate.
"In addition, confiscation must have the owner's permission or be based on a valid court decision," he said.
The two perpetrators who have now been arrested by the police at the Mataram Police Headquarters with the initials NV (36), a resident of North Ampenan, Mataram City, and LE (31), a resident of Praya, Central Lombok Regency.
"One actor has been a debt collector for 10 years and the other has only been a debt collector for one year," said Kadek Adi.
From the results of the investigation, the police have found indications of the crimes of the two perpetrators. The two people have been named as suspects.
In their status as suspects, both are threatened by Article 368 Paragraph 1 Jo Article 55 Paragraph 1 of the Criminal Code or Article 335 Paragraph 1 concerning Extortion and the threat of a maximum sentence of 9 years in prison.
