JAKARTA - Constitutional law expert Yusril Ihza Mahendra responded to the decision of the Constitutional Court (MK) which rejected the presidential-cawapres age limit lawsuit filed by several parties.

From this decision, Yusril views the accusation that the Constitutional Court is not independent because Chief Justice of the Constitutional Court Anwar Usman is the brother-in-law of President Joko Widodo to be unproven.

This is because the Constitutional Court has not granted a decrease in the age limit of the presidential and vice presidential candidates to a minimum of 35 years which is said to have made Gibran Rakabuming Raka, Jokowi's son, meet the requirements as a presidential and vice presidential candidate in the 2024 election.

"The allegation that Anwar, Jokowi, Gibran, and even Kaesang, who later became PSI Chairs as applicants, would make the Constitutional Court a 'Family Court' not proven," said Yusril in his statement, Monday, October 16.

Seeing the results of this decision, Yusril views that the Constitutional Court still has integrity as the guardian of the constitutional supremacy. Yusril continued, the Constitutional Court can position itself as the guardian of the constitution and is not easily intervened by anyone.

"Chairman of the Constitutional Court Anwar Usman, who is the brother-in-law of President Joko Widodo and the uncle of Gibran Rakabuming Raka who is suspected of having an interest in the petition, seems to agree with the majority of judges in the Constitutional Court," he explained.

It is known that the Constitutional Court rejected the presidential-cawapres age limit lawsuit filed by PSI. The authority of the age limit is the authority of the DPR. The presidential-vice presidential age limit remains at 40 years

"Reject the petitioners in its entirety," said Chief Justice of the Constitutional Court Anwar Usman.

The Constitutional Court stated that it was unable to determine the minimum age limit for presidential and vice presidential candidates. The reason for the determination by the Constitutional Court is that it is possible to cause dynamics.

"The Court cannot determine the minimum age limit for presidential and vice presidential candidates because of the possibility of dynamics in the future," said judge of the Constitutional Court Saldi Isra.

"In addition, if the Court determines it, the flexibility will be lost and can trigger the emergence of various applications related to the requirements for the minimum age of other public positions to the Constitutional Court," continued Saldi.
