North Sumatra Prosecutor's Office Stops The Theft Case Of 15 Kg Kelapa Sawit In Simalungun

The North Sumatra High Prosecutor's Office (North Sumatra) has stopped prosecuting two cases of theft of oil palm at the Simalungun District Attorney's Office and the Deli Serdang District Attorney's Branch in Labuhan Deli with a restorative justice (RJ) approach.

"Previously, Deputy Head of North Sumatra Joko Purwanto and his staff exposed the case, submitted by the Deputy Attorney General for General Crimes (Jampidum) Asri Agung Putra, Tuesday (10/10)," said Head of the Legal Information Section of the North Sumatra Attorney General's Office Yos A Tarigan Thursday, October 12.

He said the case filed from the Simalungun District Attorney's Office with the suspect Rafik Zahari took a 15 kilogram palm brondolalan belonging to PT Kersaan Indonesia.

"The suspect was charged with Article 111 of Law No. 39 of 2014 concerning plantations or Article 107 Letter d of Law No. 39 of 2014 concerning plantations," he said.

Yos continued the next case from the Deli Serdang District Attorney's Branch in Labuhan Deli with the suspect Ratno Syahputra alias Dede who took a brondonan of palm oil with Riko (DPO) owned by PTPN II Kebun Tandem in Hamparan Perak District, Deli Medium Regency.

"For his actions, the suspect was charged with Article 111 of Law No. 39 of 2014 concerning plantations in conjunction with Article 55 of the Criminal Code or Article 107 Letter d of Law No. 39 of 2014 concerning plantations in conjunction with Article 55 of the Criminal Code," he said.

The prosecution, according to him, is based on the prosecutor's regulation (Perja) Number 15 of 2020 concerning termination of prosecution based on restorative justice, meaning that between the suspect and the victim there is no longer any grudge.

In addition, the peace implementation process was witnessed by families, community leaders, religious leaders, and facilitated by each Kajari and accompanied by prosecutors who handled the case.

"Between the suspect and the victim, we have agreed to make peace and open up a legal space to create harmony in the community, there will be no more grudges in the future," he said.
