JAKARTA - Secretary General (Secretary General) of Bawaslu Ichsan Fuady explained that Circular Letter (SE) Number 3 of 2023 was issued based on the reasons for the need for human resources (HR) within the Secretariat General Bawaslu.

The circular is about the participation of secretariat general employees of the general election supervisory agency, secretariat of the provincial general election supervisory agency, district/city in the selection process for general election organizers.

"In our decision to issue it is with the first consideration of the need (HR)," said Ichsan Fuady in a hearing to examine alleged violations of the Election Organizer Code of Ethics (KEPP) for case Number 97-PKE-DKPP/VII/2023 at the Election Organizers Honorary Council (DKPP), as monitored online through the DKPP YouTube channel reported by ANTARA, Thursday, August 3.

Ichsan Fuady said that based on data from the HR and General Bureau of Bawaslu, the total need for Bawaslu employees to carry out election supervision tasks was 31,496 employees. However, Bawaslu still lacks 20,568 employees at the time of the 2024 election stage.

Ichsan explained that based on Bawaslu Regulation Number 13 of 2020 concerning the Official Script, the Secretariat General Bawaslu as the staffing officer (PPK) has the authority to issue SE.

"PPK has the authority to issue a circular letter of substance regarding the function and authority of the General Bawaslu Secretariat, including policies in determining the granting of permits for Bawaslu organic civil servants who take part in the selection of selection of members of non-structural institutions," he said.

Meanwhile, civil servant (PNS) at the Secretariat of the Indonesian General Election Supervisory Agency (Bawaslu) Indrawati as the complainant assessed that SE Number 3/2023, which was published on March 21, 2023, had harmed and reduced its constitutional rights so that it could not participate in the selection as a candidate for district/city Bawaslu member in West Kalimantan ahead of its retirement in November.

"With the issuance of SE 3/2023, it has limited the constitutional rights as an Indonesian citizen to get a job and a living, where the complainant will soon retire or retire," said the attorney for complainant Rahmat Devi Irawan.

In fact, he continued, based on the provisions of Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, each citizen has the right to work and a decent living for humanity.

"With the complainants participating in the selection, there is still hope that the complainants will return to serve the nation and state as members of the district/city Bawaslu if elected later," he said.

According to him, the Secretary General of Bawaslu Ichsan Fuady should be able to provide a different policy by granting permission or access to complainants to participate in the selection of candidates for district/city Bawaslu members.

"It is not good for Bawaslu of the Republic of Indonesia to issue SE Number 3 of 2003 by stopping the complainant's desire to register on the grounds that there is a shortage of human resources in the environment with a very baseless and non-objective scope. This selection process is also only carried out once every 5 years," he said.

For this reason, Indrawati in her petitum asked the DKPP panel to grant her request in its entirety, and cancel SE Number 3/2023 and impose sanctions on the Secretary General of the Indonesian Bawaslu Ichsan Fuady.

"Granted the complainant's request to participate in the selection process for registration of candidates for district/city Bawaslu members as announced by the registration of candidates for district/city Bawaslu members," he said.
