Seven-Year Fugitive, Caught, And Finally Arrested

TANJUNGPINANG- Faly Kartini Simanjuntak has been on the wanted list for seven years. Now he has been arrested by the Fugitive Team of the Riau Islands High Prosecutor's Office.

Asintel Kejati Kepri, Lambok MJ Sidabutar said the convict Faly Kartini Simanjuntak was arrested in Pekanbaru, Riau Province, after his whereabouts were caught from information from the Adhyaksa Monitoring Center (AMC).

"Initially, according to AMC information, the Kepri Prosecutor's Office Intelligence Team left for Pekanbaru on Wednesday, May 24, 2023, to the location where the convict was hiding," he said in Tanjungpinang, Saturday.

According to him, the certainty of the whereabouts of the convict will only be known on Thursday, May 25, 2023, at 16.00 WIB.

After that, the Riau Islands High Prosecutor's Office Sow Team coordinated with the Pekanbaru District Attorney and Police to pick up the convicts on Pandan Wangi Street, RT02/RW10 Number 06, North Tangkerang, Pekanbaru.

At first, the family insisted on not being willing to hand over the convict to a debate between the family and the Kepri Attorney General's Office Intelligence Team.

However, persuasively, the reasons for the convicts to carry out the Supreme Court's decision which has permanent legal force so that whether they like it or not the convicts must be brought to be executed in order to carry out the corporal prison sentence for the convicts.

Lambok said that at 23.00 WIB, the convict was finally taken to the Pekanbaru District Attorney's office and secured in a special room.

"The day after, Friday (26/5) at 10.00 WIB, the convict was handed over to the executor prosecutor (Jaksa P-48) from the Batam District Attorney to be put in prison at the Pekanbaru Penitentiary," he said, quoted by ANTARA, Saturday, May 27.

Lambok explained that the corruption case of Faly Kartini Simanjuntak began when the convict submitted a request for a mortgage loan for house renovation purposes with the address Jalan Bunga Raya Number 5 D Baloi, Batam City, Riau Province, to Bank BPD Riau Batam Branch amounting to Rp1.2 billion.

The convict attaches a work certificate, salary slip and a statement letter of PT Golden Mutiara Line Number 003/Dir/GML/2007 on December 5, 2007, with land and building guarantees covering an area of 404 square meters, with additional income/payment collateral of IDR 31 million per month based on an income/payment certificate issued and signed by Adi Subarkah as HRD Manager of PT Golden Mutiara Line without being accompanied by Article 21.

The certificate was then submitted by the convict to Bank BPD Riau Batam Branch and attached as a requirement to apply for a mortgage loan loan.

Based on the income/payment certificate, it seems as if there is a commitment from the convict Faly Kartini Simanjuntak to pay credit installments every month with the intention that the loan granted can be granted.

"In fact, in fact, the convict's salary is actually far below that amount. In addition, he also did not attach a budget plan (RAB) to renovate his house," said Lambok.

The money from credit for the purpose of renovating the house proposed by the convict did not match its designation. Instead, the convict was deposited into several accounts in the name of other people.

According to the credit deed, the convict should have an obligation every month to disburse his debt to Bank Riau Kepri Batam Branch of IDR 12 million.

However, the convict only disbursed his debt ten times from April 2009 to January 2010 and until now he has not paid his installments to the bank.

Based on the decision of the Cassation of the Supreme Court of the Republic of Indonesia Number: 15/PID.SUD-TPK/2015/PT.PBR dated September 7, 2015, the convict Faly Kartini Simanjuntak was declared legally and convincingly guilty of committing a criminal act of corruption on loan credit at Bank BPD Riau Batam Branch and sentenced to four years in prison and a fine of Rp. 200 million.

"With the provision that if the sentence is not paid by the defendant, it will be replaced with imprisonment for two months and pay compensation of Rp487 million, subsidiary to one month in prison," said Lambok.
