Contract Tents With The Ministry Of Law And Human Rights, 13 LBHs In South Sumatra Ready To Help People Contained By Law

SOUTH Sumatra (Sumsel) Ministry of Law and Human Rights (Kemenkumham) collaborated with 13 legal aid organizations (LBH/OBH) to help underprivileged communities who were involved in criminal and civil law problems in this area.

The legal aid organization was chosen after going through the verification process and obtained an accreditation from the Ministry of Law and Human Rights, said Head of the Legal and Human Rights Service Division (Kadivykumanham) of the South Sumatra Ministry of Law and Human Rights Regional Office, Parsaoran Simaibang, in Palembang, Friday, December 2.

He explained that the 13 LBH/OBH were the Legal Aid Foundation for Geradin Baturaja, the Indonesian Advocates Legal Aid Post in Palembang, the Indonesian Legal Aid Foundation for Legal Aid Institutions (YLBHI LBH) Palembang, the Legal Aid Foundation Sejahtera Palembang Sriwijaya, the South Sumatra Legal Aid Institute (LBH Sumsel).

Then, the Lahat Legal Aid Institute, the Palembang Peradi Legal Aid Center, the Legal Office of the Abdi Policy on the Law of the Youth Pledge Law College, the Muara Enim Excise Legal Aid Bureau, the Banyuasin Musi Legal Consultation and Aid Institute, the South Sumatra Apik Legal Aid Foundation, the Pagar Alam branch LBH, the South Sumatra Kadin Legal Aid Foundation I(YLBH).

Based on data sources for the 2022 Sidbankum Application, the number of cases handled by LBH/OBH is 76 civil cases and 134 criminal cases.

According to Simaibang, the free legal assistance is mandated by Law Number 16 of 2011 concerning Legal Aid and Permenkumham No. 4 of 2021 concerning Standards for Legal Aid and Standard Service Guidelines.

Then it is also regulated in the Decree of the Minister of Law and Human Rights Number: M-HH.01.HN.03.03 of 2017 concerning the Amount of Legal Aid Fees for Litigation and Nonligation.

Based on the Antara report, the recipients of this free legal aid are groups of people/people unable to be proven by the existence of an incapacity certificate (SKTM) from the local village head or village head. A total of 13 OBHs are obliged to provide legal assistance for litigation and non-ligation to the community.

"The litigation case is resolved through the court, while the non-ligacy case is resolved outside the court, for example through negotiations or mediation," he said.

Meanwhile, the Head of the Regional Office of the Ministry of Law and Human Rights of South Sumatra, Harun Sulianto, hopes that the legal assistance provided by LBH/OBH can help the poor when dealing with the law.

"This legal assistance shows the presence of the state in protecting and guaranteeing human rights with financial support reaching Rp. 723,838,500, the largest allocated for legal assistance services for litigation cases reaching Rp. 647,000,000, while non-ligating Rp. 76,838,500," he said.
