The Family Of Brigadier J Heraan There Is An Allegation Of Harassment, Komnas HAM With Retailed Regulations Of TPKS Law

JAKARTA - The family lawyer Brigadier Nopryansah Yosua Hutabarat or Brigadier J feels strange with Komnas HAM's recommendation regarding the alleged abuse of Ferdy Sambo Putri Candrawati's wife in Magelang.

This oddity was because initially Komnas HAM did not find any element of harassment in this case. Even the Criminal Investigation Department has stopped the investigation related to alleged sexual violence. However, Komnas HAM said that there was no element of sexual harassment, namely in an incident in Jakarta. Meanwhile, for the incident in Magelang, Komnas HAM submitted an investigation into the alleged abuse to the police.

"I don't believe that must be proven, anyway. So let the investigators prove it. Once again with the help of experts," said Komnas HAM Chairman Ahmad Taufan Damanik to reporters, Saturday, September 3. Taufan explained that the Law on Non-Corruption Violence (UU TPKS) stipulates that the testimony of witnesses or victims is evidence.

"It is necessary to study the TPKS Law which regulates evidence in article 25. The testimony of witnesses or victims is evidence, this is different from other criminal acts where information is the lowest evidence," he said. "In the case of alleged harassment in Magelang, there is a PC statement as a victim, information from Susi, KM and RR. So there are 4 pieces of evidence in accordance with the TPKS Law," he continued. As is known, the Criminal Investigation Unit of the Police has stopped investigating the alleged harassment case by Brigadier J against the wife of Inspector General Ferdy Sambo, Putri Candrawati.

The police report (LP) was registered with the number LPB1630/VII/2022/SPKT/South Jakarta Metro Police Metro Police on July 9, 2022. The report was registered by Putri Candawathi. However, recently, the National Human Rights Commission (Komnas HAM) concluded that Brigadier J had strongly suspected of sexual violence against Putri Candrawati, wife of Inspector General Ferdy Sambo.

The allegation was revealed by Komnas HAM Commissioner for Counseling, Beka Ulung Hapsara when reading the report on the investigation into the murder of Brigadier J, Thursday, September 1.

"There is a strong suspicion that there was an incident of sexual violence committed by Brigadier J against a PC sister in Magelang on July 7, 2022," said Beka.
