JAKARTA - Prosecutors from the Corruption Eradication Commission (KPK) present five civil servants from the Bogor Regency Government, West Java as witnesses for the defendant inactive Regent Ade Yasin in the alleged bribery case of the BPK RI auditors.

Five civil servants who were present at the Bandung Corruption Court were Regional Secretary (Sekda) Burhanudin, Sub-Coordinator of Reporting for the Regional Financial and Asset Management Agency (BPKAD) Hany Lesmanawaty.

Then, the Head of Accounting and Information Technology of BPKAD Wiwin Yeti Heryati, Secretary of BPKAD Andri Hadian, and Head of BPKAD Teuku Mulya.

The KPK Public Prosecutor will present at least 40 witnesses on the agenda of the evidentiary hearing. The witnesses consisted of environmental employees of the Bogor Regency Government and businessmen.

Previously, Ade Yasin, through his attorney, Dinalara Butar Butar, was optimistic that he would prove that his client was not involved in the alleged bribery case against an employee of the Indonesian Supreme Audit Agency (BPK) for the West Java Representative.

"We are very optimistic that we can prove that our client is innocent in this case," he said, quoted from Antara, Wednesday, August 3.

According to him, although the defendant's exception or objection note was not accepted by the panel of judges chaired by Hera Kartiningsih, his party believes that the judge will be objective and uphold justice.

"We really appreciate respecting the interlocutory decision read by the panel of judges today, because indeed the interlocutory decision is not the end of everything. The purpose of this interlocutory decision is to expedite the trial," said Dinalara.

He is optimistic that the witnesses presented will reveal Ade Yasin's absence. Moreover, according to him, the KPK's evidence was incomplete when it dragged its client to the alleged bribery case against BPK employees.

He said, referring to Article 17 of the Criminal Procedure Code (KUHAP), the arrest of a person suspected of committing a crime needs to be accompanied by sufficient initial evidence, namely at least two valid pieces of evidence.

The reason is, after the arrest, the KPK announced that the pick-up of Ade Yasin as a witness at the official residence on April 27, 2022, was an event of a hand arrest operation (OTT).

"The prosecutor (prosecutor) did not explain in his indictment what two sufficient pieces of evidence the KPK had, so the defendant had to be OTT," he also said.

In fact, according to him, Ade Yasin was picked up by KPK officers for questioning as witnesses for the arrests of several Bogor Regency Government employees and West Java Representative Audit Board employees.

Dinalara also admitted that he was surprised because the KPK picked up Ade Yasin as a witness in the early hours of the morning at around 03.00 WIB.

"If you really want to ask for information, why can't you pick up during normal hours, or call Ade Yasin to the KPK," said Dinalara.

Ade Yasin was accused by the Prosecutor of the Corruption Eradication Commission of giving bribes of Rp. 1.9 billion to win the title of unqualified opinion (WTP).

KPK prosecutor Budiman Abdul Karib said the bribes were given to four BPK employees who have also become suspects in the case.

"So it is seen as an act of continuing to give or promise something, namely giving money in the total amount of Rp. 1,935,000,000 to civil servants or state officials," said Budiman.
