DENPASAR - Minister of Law and Human Rights (Menkumham) Yasonna Laoly said membership of the Financial Action Task Force (FATF) is proof that Indonesia has the legal infrastructure to combat Money Laundering (TPPU) and Terrorism Financing (TPPT) crimes.

"Membership in the FATF is important and has a wide impact, because it is proof that Indonesia already has an effective legal infrastructure and institutional infrastructure in combating and preventing the occurrence of Money Laundering and Terrorism Financing Crimes," Laoly said as quoted by ANTARA, Monday, 25 July.

The Minister of Law and Human Rights asked the Ministry of Law and Human Rights, the Notary Supervisory Council (MPN), and the Notary Honorary Council (MKN) to increase supervision of notaries as a requirement for entering FATF members.

Laoly said Indonesia is currently undergoing a Mutual Evaluation Review (MER) regarding Indonesia's efforts to become a member of the FATF as directed by President Joko Widodo.

Effective and professional supervision of notaries is absolutely necessary, he said, because it is one of the requirements that the Indonesian government must fulfill in the process of becoming a member of the FATF.

Unfortunately, he continued, the supervision so far has not been maximized, so the Government must immediately strengthen and improve the notary supervision mechanism. Based on the data received, he said there were many problems related to the implementation of the duties of a notary public.

"Various violations committed by these notaries have legal consequences that lead to lawsuits against the Ministry of Law and Human Rights, both through district courts and state administrative courts, to reporting alleged criminal acts to law enforcement officials," he explained.

This was stated by Laoly when opening the Coordination Meeting of the Directorate General of General Legal Administration (AHU) with MKN and MPN at the Westin Hotel, Nusa Dua, Bali, Monday.

The Minister of Law and Human Rights explained that the duties and responsibilities of a notary in carrying out the profession must be in direct contact with community activities. Therefore, as a public official who is authorized to make an authentic deed, a notary is expected to have sensitivity in conducting due diligence.

"The notary is obliged to ensure the truth of the contents of the document or information from the appearer which is then poured into the deed," he said.

Laoly hopes that MPN and MKN can synergize in carrying out the duties of coaching and supervising notaries in a professional manner, so that public trust in notary supervisory institutions will increase, be sure and orderly.

Meanwhile, Director General of AHU Cahyo R. Muzhar in his report revealed that this coordination meeting was held in the middle of the MER implementation which took place from 18 July to 4 August 2022, and was one of the stages in Indonesia's membership process in the FATF.
