UGM Pukat Urges The KPK To Snatch Corporates In Bribery Cases Of Ex-Walker Of Yogyakarta Haryadi Suyuti

JAKARTA - The Center for Anti-Corruption Studies at Gadjah Mada University (Pukat UGM) has urged the Corruption Eradication Commission (KPK) to ensnare a corporation in the alleged bribery case for licensing the construction of an apartment building received by former Yogyakarta Mayor Haryadi Suyuti.

"This is important for deterrence so that other corporations that will operate in Yogyakarta do not use unlawful methods such as bribes or gratuities," said UGM Pukat researcher Zaenur Rohman, at the Yogyakarta Legal Aid Institute (LBH) office, quoted by Antara, Thursday, 9 June.

Although the KPK has named PT Summarecon Agung Tbk Vice President Real Estate Oon Nusihono (ON) as a suspect for giving bribes, according to him, the corporation must also be held criminally responsible.

Because, according to Zaenur, such bribery is confirmed for and on behalf of the corporation.

"In such a context, the corporation must also be held criminally responsible, so it must use the 'corporate criminal liability' approach," he said.

According to Supreme Court Regulation (Perma) No. 13/2016, according to him, the KPK can ensnare corporations when corporations allow or do not take steps to prevent a criminal act from occurring.

Thus, according to him, PT Summarecon Agung can also be named a suspect in the bribery case if the elements or the adequacy of the evidence are met.

"It can be a 'shock therapy' for the private sector, for the business world. So everything must be cleaned up comprehensively, not only the bureaucracy," said Zanur Rohman.

The Corruption Eradication Commission (KPK) has secured documents and a sum of money from a search at the PT Summarecon Agung (SA) Tbk. Office, East Jakarta, Monday (6/6), in an investigation into the alleged bribery case in the administration of permits in the Yogyakarta City Government (Pemkot).

According to Acting KPK Spokesman Ali Fikri, the evidence was immediately confiscated as evidence and re-confirmed to the witnesses who would later be summoned.
