JAKARTA - Former Ministry of Energy and Mineral Resources (ESDM) official Sri Utami was sentenced to 4 years and 3 months in prison for allegedly carrying out a number of fictitious procurements in 2012 that cost the state Rp11,124 billion.

"So that the panel of judges declares that the defendant Sri Utami has been legally and convincingly proven to have committed a criminal act of corruption and sentenced the defendant to imprisonment for 4 years and 3 months plus a fine of Rp. at the Jakarta Corruption Court (Tipikor) reported by Antara, Tuesday, May 24.

He is considered proven to have committed the second alternative charge, namely Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code jo. Article 65 paragraph (1) of the Criminal Code.

Burdening the defendant to pay a replacement money of IDR 2.398 billion to the state with the stipulation that if within 1 month after the court's decision obtains permanent legal force the defendant does not pay, his assets can be confiscated by the prosecutor and auctioned off to cover the replacement money, in the event that the defendant does not have property that is sufficient to pay the replacement money will be punished with imprisonment for 1 year," added prosecutor Agus.

There are a number of aggravating and mitigating things in Sri Utami's actions.

"The aggravating thing is that the defendant does not support the government's program in realizing a government that is clean of collusion, corruption, and nepotism, the defendant is less open in giving information. The mitigating thing is that the defendant has family responsibilities, is polite and respects the trial, has never been sentenced before," said prosecutor.

In her actions, Sri Utami is considered proven to have received Rp 2,398 billion of money with Rp 1,498 billion of receipts from the Socialization Activities in the Energy and Mineral Resources Sector for Subsidized Fuel Oil for the 2012 Financial Year and Rp 900 million in receipts from the Healthy Bike Activities in the Context of Savings Socialization. All of Sri Utami's actions cost the state Rp11,124 billion.

Sri Utami was appointed by the former Secretary General of the Ministry of Energy and Mineral Resources, Waryono Karno, seeking funds taken from various activities of the Secretariat General of Energy and Mineral Resources.

These activities are: first, the socialization of the energy and mineral resources sector of subsidized fuel oil (BBM) in 2012. The socialization activity with a budget of Rp. 5,309 billion was divided into 48 activities with a value of around Rp. 100 million.

The total money collected from the activities was IDR 2,964 billion which was submitted to Sri Utami, then Sri Utami used IDR 1,465 billion for activities at the Secretariat General that were not funded by the APBN, among others, to be given to NGOs, community organizations, Paspampres, holiday allowances, journalists, office boys, travel, vehicle registration extensions, office operations, and others.

The remaining money was divided between Poppy Dinianova (Rp 148 million), Jasni (Rp 156.224 million), Teuku Bahagia (Rp 120.4 million), and working capital (Rp 100 million).

Second, the healthy bicycle activity in the context of energy-saving socialization in 2012 with a total budget of Rp.4.175 billion was divided into 43 activity packages with a value of under Rp.100 million.

The money amounting to Rp1.1 billion was then handed over to Sri Utami for the activities of the Secretariat General of Energy and Mineral Resources which were not funded by the APBN, while the rest was received by Poppy (Rp437.6 million), Jasni (Rp318.469 million), Dwi Purwanto (Rp15 million), Bambang WIjiatmoko (Rp20 million). million), and Johan (Rp. 1.034 billion).

Third, maintenance of the ESDM Secretariat office building in 2012 with a budget of IDR 37.817 billion for the renovation of three buildings, namely: the Secretariat General of the Ministry of Energy and Mineral Resources (Plaza Centris) building on Jalan HR Rasuna Said, South Jakarta (Rp 1.83 billion); Secretariat General of the Ministry of Energy and Mineral Resources, Jalan Pegangsaan Timur No. 1A Cikini, Central Jakarta (Rp.2,693 billion); and the Secretariat General of the Ministry of Energy and Mineral Resources, Jalan Medan Merdeka Selatan No. 18 Central Jakarta (Rp7.968 billion).

The renovation work on the three buildings was also divided into small maintenance packages, namely into 142 packages by borrowing several companies to act as if they were carrying out the work with a loan fee of 2-5 percent of the project value.
