JAKARTA - Polda Metro Jaya denies that the determination of suspect status to Director Lokataru Haris Azhar and KontraS Coordinator Fatia Maulidiyanti in the alleged defamation case against Luhut Binsar Pandjaitan constitutes the criminalization of activists.

The Head of Public Relations of the Polda Metro Jaya Kombes Endra Zulpan said that the determination of the suspects Haris Azhar and Fatia was in accordance with the legal facts obtained during the case.

"No (criminalizing). We work based on legal facts. So, we hope that everyone follows the existing mechanism, including them," said Zulpan when confirmed, Sunday, March 20.

Zulpan emphasized that the determination of the suspect was in accordance with Article 184 Paragraph (1) of the Criminal Procedure Code. In the article, it is stated that the valid evidence is witness testimony, expert testimony, letters, instructions, and the defendant's testimony.

"Of course, investigators based on Article 184 of the Criminal Code, we work according to the legal facts of determining the suspect, there are provisions, namely 184 of the Criminal Code, a minimum of two pieces of evidence," explained Zulpan.

The police have named activist Haris Azhar and KontraS Coordinator, Fatia Maulidiyanti, as suspects for alleged defamation of the Coordinating Minister for Maritime Affairs and Investment Luhut Binsar Pandjaitan.

In this case, Luhut reported Haris Azhar and Fatia Maulidiyanti for the circulation of a video entitled "There is Lord Luhut Behind Intan Jaya's Economic Relations-Military Ops" on Haris Azhar's YouTube account.

The determination of the suspect was strongly condemned by the National Committee for Agrarian Reform (KNPA). KNPA considers the police to have criminalized activists. Because, according to him, the law should not be given to critics.

Fines and criminal sanctions for critics accused of defamation should be replaced with the right to correct or answer.
