Mobile Phone Thief Grandfather Freed Through Restorative Justice

BOGOR - The grandfather of the perpetrator of the theft of a cellphone worth IDR 2.5 million and his partner, Irawan, are now free after the termination of prosecution by the District Attorney (Kejari), Bogor Regency, West Java, through the method of restorative justice.

"The termination of prosecution is based on the provisions contained in the Regulation of the Prosecutor's Office of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice by considering various aspects," said Bogor Regency Attorney General Agustian Sunaryo as quoted by Antara, Wednesday, March 2.

Kadir's grandfather, as he is called, and Irawan were officially released starting Wednesday, March 2, after being detained since December 3, 2021 in the Bogor Police Headquarters Detention Room.

Agustian said several reasons that made the two of them get restorative justice were that they had only recently committed a crime, economic incapacity, and the suspect Kadir was already an elderly person and had suffered a stroke.

Then, restorative justice can also be fulfilled because the victim with the initials MD (15) and her mother Siti Maryam Nurlela have forgiven and received compensation from the suspects.

The theft occurred on Sunday, November 28, 2021, at around 11.00 WIB in front of Cibinong City Mall (CCM), Cibinong, Bogor Regency.

At that time, the suspects, Grandpa Kadir and Irawan, met the victim MD, and gave him a ring which he said could be used for self-defense. The two suspects then asked the victim MD to walk using a ring by leaving his cellphone first.

However, after MD returned to his original place, the two suspects were no longer at the location and took MD's cellphone.

"After getting the victim's cellphone, then the suspect sold it for Rp. 600,000 which was divided by Rp. 300,000 each for daily needs and stroke treatment," explained Agustian.

The process for submitting the termination of the case at the Bogor District Attorney's Office began when the suspect and evidence were handed over (Phase II) by Cibinong Police investigators on Monday, February 14, 2022.
