JAKARTA - The Corruption Eradication Commission (KPK) asserts that it has no intention of blocking anyone who wants to become its employee through Commission Regulation (Perkom) Number 1 of 2022.

Harefa in response to the polemic that arose as a result of a commission regulation signed by KPK Chairman Firli Bahuri on January 27 last. The regulation states that employees who have been honorably dismissed but not at their request cannot become KPK employees.

"There is no intention at all to unconstitutionally prevent certain parties from joining the KPK's ASN employees," Cahya told reporters in a written statement, Friday, February 11.

Cahya explained that the Perkom was made to update rules that were no longer relevant. Moreover, currently the status of KPK employees has changed to ASN according to the mandate of Law Number 19 of 2019.

There are also regulations that serve as references for making the Perkom, namely Law Number 5 of 2014 concerning State Civil Apparatus, PP Number 11 of 2017 concerning Management of Civil Servants, and PP Number 49 of 2018 concerning Management of Government Employees with Work Agreements (PPPK).

"This Perkom is general in nature and adheres to the applicable ASN regulations," he said.

In addition, Cahya also explained that there was an adjustment to the phrase 'commission employee' in Articles 6 and 11 of Perkom 1 of 2022. He said the addition occurred because commission employees before ASN were not included in the TNI, Police, or Civil Servant categories as stated in Article 23 PP. Number 11 of 2017.

"So this Perkom is important to add the phrase 'commission employee' so that there is harmonization and harmonization of the substance of the provisions in the PP," he said.

"This is also considering the transition from the status of KPK employees to state civil servants after the PP was promulgated," Pahala added.

Never been dismissed with honor, not at his own request or dishonorably as a civil servant, Indonesian National Army soldier, member of the Indonesian National Police, Commission employee or dishonorably dismissed as a private employee. Obtained permission from the head of the parent agency, and was declared to have passed the selection.
