PT Adonara Propertindo Land Provider Company DP Rp0 Sued By KPK Prosecutors Closed For 1 Year

JAKARTA - PT Adonara Propertindo as a partner of the DKI Jakarta Provincial Government's Regional Owned Enterprise (BUMD) Pembangunan Sarana Jaya is charged with not operating for one year in the alleged corruption case of land acquisition for the "DP 0 Rupiah Residential" project in Munjul, East Jakarta which cost the state Rp152,565 billion.

"The defendant PT Adonara Propertindo also sentenced the defendant to an additional crime in the form of closing the entire company PT Adonara Propertindo for one year," said KPK public prosecutor Muh Helmi Syarif at the Jakarta Corruption Court (Tipikor) as reported by Antara, Thursday, February 10.

The claim is based on the first indictment of Article 2 paragraph (1) of the Law in conjunction with Article 18 No 31 of 1999 as amended by Law 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code. .

Sitting in the defendant's chair to represent PT Adonara Propertindo the company was Tommy Adrian.

The other defendants in this case are Director of PT Adonara Propertindo Tommy Adrian and two beneficial owners of PT Adonara Propertindo, namely Anja Runtuwene and Rudy Hartono Iskandar.

"Declaring that the defendant PT Adonara Propertindo is legally and convincingly proven guilty of committing a criminal act of corruption together and continuously," added the prosecutor.

The KPK prosecutor also gave a fine of Rp. 200 million to PT Adonara Propertindo.

Sentenced the principal criminal against the corporate defendant PT Adonara Propertindo in the form of a fine of Rp. 200 million with the provisions, if the fine is not paid no later than one month after the decision has permanent legal force and if there is a strong reason the period as referred to can be extended again for a maximum of one month, But PT Adonara Propertindo did not pay the fine, so the property can be confiscated by the prosecutor and auctioned off to pay the fine," said the prosecutor.

In his letter of demand, the KPK prosecutor stated that the two beneficial owners of PT Adonara Propertindo, namely Anja Runtuwene and Rudy Hartono Iskandar and PT Adonara Propertindo had handed over money and the value of assets whose value exceeded the state financial loss of Rp. 152.565 billion.

The details of the return of assets by Anja Runtuwene, Rudy Hartono Iskandar and PT Adonara Propertindo are:

1. 1 unit of Mini Cooper S type Convertible A/T on behalf of PT Adonara Propertindo worth IDR 1.2 billion

2. 1 plot of land in Badung, Bali covering an area of 690 square meters with a NJOP of IDR 4.274 billion

3. 1 plot of land in Badung, Bali with an area of 1,437 square meters with a NJOP of IDR 8.902 billion

4. 1 plot of land in Tibubeneng Bali with an area of 5,150 square meters with a NJOP of IDR 26,239 billion

5. 1 plot of land in Pancoran Mas, Depok with an area of 6,625 square meters worth Rp. 114.248 billion

So the total is IDR 154.864 billion.

"By taking into account the amount of money and assets returned by Defendant II Anja Runtuwene and Defendant III Rudy Hartono Iskandar as well as state/regional losses due to the actions of defendants Tommy Adrian, Anja Runtuwene and Rudy Hartono, according to law, the money and assets that were handed over for confiscation for the state to compensate for state financial losses and reduce the obligation to pay replacement money," added the prosecutor.

This means that the KPK prosecutor stated that Tommy Adrian, Anja Runtuwene and Rudy Hartono no longer needed to be burdened with the obligation to pay replacement money.

However, the three of them were still charged with criminal penalties, namely Tommy Adrian was sentenced to 7 years in prison, Anja Runtuwene was sentenced to 5 years and 6 months in prison while Rudy Hartono Iskandar was sentenced to 7 years in prison.

"And a fine of Rp. 500 million each, subsidiary of 2 months in prison," continued the KPK prosecutor.

The total money received in Anja Runtuwene's account amounted to Rp. 152,565,440,000 and has been used by Anja and Rudy Hartono, among others, for the operational needs of the company PT Adonara Propertindo, transferred to PT RHYS Auto Gallery which is still in the same group as PT Adonara as well as for Anja's personal needs.
