Minister Of Manpower Issues Circular Regarding National Holidays And Joint Leave For Nataru
Minister of Manpower (Menaker) Yassieril issued a Circular (SE) regarding the Implementation of National Holidays and Joint Leave at the Company.
The Director General of Industrial Relations and Social Security (PHI Jamsos) of the Ministry of Manpower, Indah Anggoro Putri, said that this new policy is focused on non-ASN or non-civil servant workers.
"The Ministry of Manpower hopes that workers and employers can comply with the SE and together we welcome the Christmas and New Year holidays with joy," he said in his statement to the media, Thursday, December 12.
In the circular, it is stated that workers/laborers are not required to work on national holidays or official holidays. Furthermore, employers who employ workers or laborers who do work on national holidays or official holidays are required to pay overtime wages.
Then for the implementation of collective leave, the Minister of Manpower emphasized that collective leave is part of annual leave and is a fatulative or choice in accordance with the agreement between employers with workers/laborers and/or trade unions or labor unions with employers, work agreements, company regulations, or joint work agreements and laws and regulations taking into account the company's operational conditions and needs.
"The worker/laborer who takes leave on the leave day he takes reduces the right to the year's leave of the worker/labor concerned," reads the circular.

Finally, workers/laborers who work on collective leave days, their annual leave rights do not decrease and the money is paid upaj like usual working days.
With the issuance of this Circular Letter, Circular Letter Number M / 3 / HK.04 / IV / 2022 dated April 14, 2022 concerning the Implementation of Joint Leave to Companies, is revoked and declared invalid.
