Harvey Moeis Demanded 12 Years In Prison Plus Rp210 Billion In Replacement Money

JAKARTA - The defendant Harvey Moeis as the extension of PT Refined Bangka Tin (RBT) was sentenced to 12 years in prison in connection with the alleged corruption case in the management of tin commodity trading in the mining permit area (IUP) of PT Timah in 2015 '2022.

"We demand that the panel of judges declare that the defendant Harvey Moeis is legally and convincingly proven to have committed a criminal act of corruption and money laundering," said Public Prosecutor (JPU) Ardito Muwardi during a trial reading the charges at the Jakarta Corruption Court, Monday, December 9.

In addition to imprisonment, Harvey was also charged with a fine of Rp. 1 billion, provided that if the fine was not paid, it would be replaced with imprisonment for one year.

The prosecutor also demanded that the panel of judges impose additional penalties on Harvey Moeis in the form of payment of compensation of Rp. 210 billion, subsidiary to imprisonment for six years.

Thus, according to the prosecutor, Harvey has violated Article 2 Paragraph (1) in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code and Article 3 of Law Number 8 of 2010 concerning the Prevention and Eradication of Criminal Acts of Corruption jo. Article 55 of the 1st Criminal Code, as in the first primary indictment.

The prosecutor considered several aggravating things, namely that Harvey's actions did not support the government's program in the context of organizing a clean and free country from corruption, collusion and nepotism.

Then, Harvey's actions were judged to have resulted in enormous state financial losses, amounting to Rp300 trillion, having benefited Harvey by Rp210 billion, and Harvey being convoluted in giving testimony at trial.

"However, there are also mitigating factors that are considered, namely that the defendant Harvey has never been convicted before," the prosecutor added.

In the tin corruption case, the defendants allegedly caused state losses of Rp. 300 trillion.

The loss included as much as Rp2.28 trillion in the form of losses for the cooperation activities of renting processing equipment (processing) logging with private smelters, Rp26.65 trillion in the form of losses due to tin seed payments to mining partners of PT Timah, and Rp271.07 trillion in the form of environmental losses.

In that case, Harvey was charged with receiving Rp420 billion in cash with PT Quantum Skyline Exchange (QSE) Manager Helena Lim, while Suparta was charged with receiving a flow of funds of Rp4.57 trillion.
